PEOPLE'S ORDINANCE NO. 10

 

 AN ORDINANCE PROVIDING FOR THE PURCHASE OF CERTAIN REAL ESTATE TO BE USED IN WHOLE OR PART AS A PUBLIC CEMETERY, TO AUTHORIZE THE EXECUTION OF CONVEYANCES OF LOTS FOR BURIAL PURPOSES AND THE ENTERING INTO OF CONTRACTS BETWEEN THE CITY OF GRAND JUNCTION AND LOT OWNERS FOR PERPETUAL MAINTENANCE OF CEMETERY LOTS.

 

 WHEREAS at the present time the public cemetery adjacent to the City of Grand Junction known as the Orchard Mesa Cemetery is privately owned, and

 

 WHEREAS, it is the desire of the citizens of Grand Junction that said city acquire by purchase the said cemetery, and also that it acquire additional ground to be used for cemetery purposes when needed, and

 

 WHEREAS, that certain ground situated south of the City known as Palmer Park was conveyed to the City subject to certain conditions and reservations among which is the condition that the said ground shall always be used for park purposes, and

 

 WHEREAS, the east one-fourth of the northwest quarter of the northeast quarter of Section 26, Township 1 South, Range 1 West of the Ute Meridian in Mesa County, Colorado, owned by Elsie Myers, Dorothy Palmer and Marjorie Palmer Watt as heirs of Wm. J. Palmer, deceased, lies adjacent to the said Palmer Park on the East and is necessary to be owned by the city for the full use and enjoyment of said Palmer Park for cemetery and other purposes, and

 

 WHEREAS, the said heirs offer to convey the said real estate and to release from all conditions and reservations that portion of Palmer Park lying East and North of the right of way of the Denver and Rio Grande Railroad, for the sum of Two Thousand Dollars ($2,000.00), and

 

 WHEREAS, the owner of the said Orchard Mesa Cemetery offers to convey the same to the City of Grand Junction subject to prior sales for burial purposes for the sum of Twenty Five Hundred Dollars ($2,500.00),

 

 THEREFORE BE IT ORDAINED, by the City Council of the City of Grand Junction and be it Ordained by the qualified electors of the said City of Grand Junction, Colorado, upon referendum by the City Council thereof:

 

 SECTION 1. That the City Council be and is hereby authorized to purchase the said East one-fourth of the northwest quarter of the northwest quarter of said Section 26, and to secure the release of that part of Palmer Park lying North and East of the right of way of the Denver and Rio Grande Railroad Company for the sum of ($2,000.00) Two Thousand Dollars.

 

 SECTION 2. That the City Council is further authorized to purchase said Orchard Mesa Cemetery for Twenty-five Hundred Dollars ($2,500.00). That the said Orchard Mesa Cemetery, situate in Mesa County, Colorado, is described as follows, to-wit:

 

Beginning at a point 30 feet South, and 870.22 feet west of the center of the northwest Quarter of Section 26, Township 1 South Range 1 West of the Ute Meridian, thence South 390.46 feet; thence East 390.46 feet; thence South 46.14 feet; thence East 479.76 feet; thence South 789.4 feet; thence West 22 feet; thence South 64 feet; thence west to the west line of said Section 26; thence North 1,290 feet; thence East 449.78 feet to the place of beginning; except right of way of D. & R. G. Railway; also except right of way of pipe line to the City of Grand Junction from the reservoirs; and except all lots heretofore deeded to various parties for burial purposes.

 

 SECTION 3. That the City Council is hereby authorized to cause the necessary surveys and cemetery plats to be made, to dedicate for street and alley purposes necessary ground, to authorize and arrange by ordinance for the sale and conveyance of lots for burial purposes and to authorize the entering into of contracts for perpetual maintenance between the City of Grand Junction and cemetery lot owners, That the said described land including Palmer Park or as much thereof as the City Council may consider necessary may be used for cemetery purposes.

 We do hereby certify that at a meeting of the City Council of the City of Grand Junction held October 21, 1921, the above and foregoing ordinance was introduced, read and ordered published and submitted to a vote of the qualified electors of the said City on November 8, 1921.

 

 That at said election the said ordinance was submitted to a vote of the qualified electors at which time the majority of the votes of said electors voting on said question were cast in favor of the adoption of said ordinance and said ordinance was thereby duly and regularly adopted.

 

 Thereafter the said ordinance was ordered recorded and numbered Peoples Ordinance No. 10 and was ordered published in the Daily Sentinel of said City.
