PEOPLE'S ORDINANCE NO. 21
AN ORDINANCE CONCERNING THE TRANSFER AND CONVEYANCE OF A TRACT OF LAND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT EIGHT HUNDRED SEVENTY (870.0) FEET WEST OF THE CENTER OF THE NORTHWEST QUARTER (NW1/4) OF SECTION 26 TWP. ONE SOUTH, RANGE ONE WEST OF THE UTE MERIDIAN; THENCE SOUTH TWO HUNDRED EIGHTY-SIX (286.0) FEET; THENCE WEST TWENTY-FIVE (25.0) FEET; THENCE ALONG A CIRCULAR CURVE RIGHT WITH A RADIUS OF ONE HUNDRED FORTY-THREE (143.0) FEET TO A POINT TWENTY-FIVE (25.0) FEET WEST OF THE PLACE OF BEGINNING; THENCE EAST TWENTY-FIVE (25.0) FEET TO THE PLACE OF BEGINNING; CONTAINING NINE-TENTHS (0.9) ACRES OF LAND, IN MESA COUNTY, COLORADO, TO THE ROBBINS-MCMULLIN POST OF THE AMERICAN LEGION FOR CEMETERY PURPOSES.
WHEREAS, The following described tract of land situated in Mesa County, Colorado, to-wit:
Beginning at a point eight hundred seventy (870.0) feet west of the center of the northwest quarter (NW1/4) of Section 26 Twp. one south, range one west of the Ute Meridian; thence south two hundred eighty-six (286.0) feet; thence west twenty-five (25.0) feet; thence along a circular curve right with a radius of one hundred forty-three (143.0) feet to a point twenty-five (25.0) feet west of the place of beginning; thence east twenty-five (25.0) feet to the place of beginning, containing nine-tenths (0.9) acres of land, is now owned by the City of Grand Junction, Colorado, and is being held by said City for cemetery purposes; and
WHEREAS, The Robbins-McMullin Post of the American Legion is the owner of an adjoining tract which is being held and used by it for cemetery purposes; and
WHEREAS, The said Robbins-McMullin Post of the American Legion desires to secure the above described tract of land from the City of Grand Junction to more adequately carry out the general plan of beautification and improvement of its cemetery, and to be held and used by it for cemetery purposes and improve and beautify same in accordance with the plans, drawings and specifications of S. R. DeBoer, city planner, now on file in the office of the City Manager of said City;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO, AND BE IT ORDAINED BY THE ELECTORS OF THE CITY OF GRAND JUNCTION, COLORADO, UPON REFERENDUM BY THE CITY COUNCIL THEREOF:
Section 1. The City Council of the City of Grand Junction, Colorado, by its President and City Clerk, under the seal of said City, are hereby authorized, directed and required to convey by good and sufficient deed of conveyance to the said THE ROBBINS-MCMULLIN POST OF THE AMERICAN LEGION the tract hereinbefore described, if, within five years from the date of final passage, adoption and approval hereof, the said THE Robbins-McMullin Post of the American Legion shall have completed or caused to have been completed the beautification and improvement of said tract in accordance with the plans and specifications and maps of said S. R. DeBoer, city planner, for the said City.
Section 2. The deed of conveyance to be made by the City of Grand Junction, Colorado, to said The Robbins-McMullin Post of the American Legion shall be subject to the condition, however, in said deed of conveyance to be expressed that the said tract is to be used by said grantee for cemetery purposes, and that all improvements, trees, shrubs, flowers and lawn thereon shall be properly maintained, irrigated and attended at all times thereafter, and that should said Grantee cease to use said tract for cemetery purposes or fail or neglect to properly maintain, irrigate and attend the same, the title to said tract shall revert at the option of said City to the said City.
WE HEREBY CERTIFY That at a regular adjourned meeting of the City Council of the City of Grand Junction, Colorado, held March 23rd, 1927, the above and foregoing ordinance was introduced, read, and ordered published and submitted to a vote of the qualified electors of said City for adoption or rejection at a regular Municipal election to be held April 5th, 1927. Pursuant thereto said Ordinance was duly and regularly published on March 24th, 1927, in The Daily Sentinel of said City, a daily newspaper of general circulation printed and published in said City, and in further pursuance thereof and in accordance with the law in such case made and provided, said Ordinance was duly and regularly submitted to a vote of said qualified electors for their adoption or rejection at a regular municipal election held in said City on the 5th day of April, A. D. 1927, at which election a majority of the votes of said electors voting on said question were cast in favor of the adoption of said ordinance and said ordinance was thereby duly and regularly adopted.
Thereafter at a regular meeting of the City Council of the City of Grand Junction held April 6th, 1927, pursuant to the Charter of said City, said Ordinance was ordered recorded and numbered People's Ordinance No. 21, and was ordered published in the Daily Sentinel of said City.
