Resolution No. 64-93
AMENDING DEVELOPMENT APPLICATION FEE SCHEDULE
WHEREAS, the Grand Junction Zoning and Development Code section 5-10-3 B.2 states "No person shall keep, house, or shelter one or more pigs, goats, burros, or mules unless such person has obtained a Conditional Use permit in accordance with the provisions of section 4-6 and 4-8 of this Code"; and
WHEREAS, the Grand Junction Zoning and Development Code section 5-1-5 A.3 states "Fences within a required setback area exceeding six feet in height are conditional uses (see section 4-6)"; and
WHEREAS, according to the City of Grand Junction Development Application Fee Schedule adopted September 16, 1992, the fee for a Conditional Use permit is $350.00; and
WHEREAS, it is unreasonable to require that a petitioner filing a Conditional Use application simply for the purpose of constructing a fence greater than six feet in height or for keeping a pig, goat, burro or mule pay the same fee as an applicant filing a Conditional Use permit application for a more substantial use; and
WHEREAS, the City Council of the City of Grand Junction has, in the past, set precedent by lowering the application fee for a Conditional Use for the purposes of keeping a pig, goat, burro or mule.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
That the City of Grand Junction Development Fee Schedule is hereby revised so that the application fee for a Conditional Use permit for a fence greater than six feet in height or for the keeping of one or more pigs, goats, burros or mules is $50.00.
