RESOLUTION NO. 123-94

 

 CONCERNING THE APPROPRIATION OF

 ADDITIONAL WATER FOR JUNIATA RESERVOIR

 AND THE JUNIATA DITCH ENLARGED

 

 

 WHEREAS, the City of Grand Junction owns the Juniata Reservoir and substantially all of the water rights in the Juniata Ditch Enlarged; and

 

 WHEREAS, the City intends to appropriate additional water rights for the Juniata Reservoir and Juniata Ditch Enlarged.

 

 NOW THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 The City intends to appropriate approximately 5950.6 A.F. of additional water for the Juniata Reservoir and 129 c.f.s. for Juniata Ditch Enlarged for the following use or proposed use:

 

 The water will be diverted to storage in/or flowed through Juniata Reservoir (including all enlargements) and it will be used in the Colorado River Basin, directly or by exchange, for all municipal uses, including, but not limited to, domestic, mechanical, manufacturing, industrial, power generation, fire protection, sewage treatment, street sprinkling, irrigation of parks, lawns and grounds, recreation, piscatorial, maintenance and preservation of wildlife and aesthetic value, lake and reservoir evaporation, augmentation, substitution and replacement, adjustment and regulation of Grand Junction's water supply system, including further exchange within Grand Junction's system and with other water users and providers in the Colorado River Basin. The water will be fully consumed through direct use, storage and subsequent release, reuse, successive use, further exchange and disposition, to the extent permitted by law.

 

 The City's Utilities Manager and counsel are directed to file an appropriate application and take such steps as may be required to secure an appropriate decree.
