RESOLUTION NO. 25-95

 

 OBJECTING TO USE OF A CITY FLOWLINE TAP

 FOR THE WATER SUPPLY TO A CAMPGROUND

 NEAR KANNAH CREEK

 

 

 

Recitals.

 

WHEREAS, the principal, and most important, source for the City's water supply is Kannah Creek, flowing west and north from the Grand Mesa. This water is conveyed to the City's water treatment plant through large pipes, commonly referred to as the 'Flowline'; and

 

 WHEREAS, in the 1970's, Congress enacted the Safe Drinking Water Act which mandated, among other things, that water for domestic purposes must be treated; and

 

 WHEREAS, in 1993 the City issued a permit to Mike and Carol Anderson (Andersons) to allow, under the conditions specified in the permit, limited use of the untreated water in the Flowline for fire fighting, irrigation and livestock watering purposes; and

 

 WHEREAS, Andersons agreed, by accepting the permit, to use no water for domestic purposes unless they treat such water, pursuant to State Health Department requirements. The only State approved system, a "point of use" filtration system, is not approved for commercial use, nor for high volume uses. As provided in the permit issued to Andersons, the permit, and the concomitant ability to obtain Flowline water, ends in the year 2000; and

 

 WHEREAS, the City recently discovered, in the course of reviewing a land use application filed by Andersons (Conditional Use Permit Application C14-95), that Andersons have represented to Mesa County that the City will provide water for their proposed activities.

 

 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 1. The City Council finds that allowing untreated water from the Flowline to supply commercial uses, such as is proposed by Andersons, is contrary to the interests of the City and its citizens.

 

 2. The City Council requests that the Planning Commission for Mesa County, and, if appropriate, the Board of Commissioners, deny the land use application as submitted unless a source of water, other than a City source, is provided.

 

 

 3. The City Council requests that the County staff and Planning Commission be aware that, in any event, the existing tap and permit (issued July 1, 1993) will end on July 1, 2000.

 

 4. Finally, the City Council states that the City has not the desire nor the intention to supply Flowline water, or other City water, for Anderson's proposed use.
