RESOLUTION NO. 33-95

 

 

 CONCERNING ESTABLISHING AN ALTERNATE POINT OF DIVERSION

 FOR GRAND JUNCTION COLORADO RIVER PIPELINE WATER RIGHT

 

 

 WHEREAS, the City of Grand Junction owns a municipal water system including reservoirs, ditches, and pipelines and the water rights decreed to those structures; and

 WHEREAS, the City's population, service area, water requirements, and uses will continue to expand in the twenty-first century; and

 WHEREAS, the City owns 80 cfs of the Grand Junction-Colorado River Pipeline water right, decreed July 21, 1959 with an appropriation date of February 17, 1947; and

 WHEREAS, the point of diversion of the Grand Junction-Colorado River Pipeline, as decreed in Civil Action No. 8303, is located on the West bank of the Colorado River at a point whence the Southwest Corner of Section 2, T 11 S, R 98 W of the 6th P.M. bears S 56° 15' W, 7,051.80 feet. In Case No. W-3532, alternate points of diversion were established for the Grand Junction-Colorado River Pipeline at the following locations:

 a)  Diversion Point No. 2 is located on the right bank of the Colorado River at a point where the Northwest Corner of Section 3, T 1 S, R 2 E of the Ute Meridian bears N 13° 18' E, 1,800 feet. This is also the point of diversion of the Grand Valley Canal.

 b)  Diversion Point No. 3 is located on the right bank of the Colorado River at a point where the Northwest Corner of Section 3, T 1 S, R 2 E of the Ute Meridian bears N 43° 33' E, 3,400 feet.

 c)  Diversion Point No. 4 is located on the right bank of the Colorado River at a point where the Southwest Corner of Section 7, T 1 S, R 2 E of the Ute Meridian bears West, 1,439.46 feet, and

 WHEREAS, the City can significantly increase the efficiency of its Colorado River water for the City's expanding population and service area without significant capital cost if an additional alternate point of diversion is acquired.

 WHEREAS, special Water Counsel did apply for an additional point of diversion during March 1995, near the 5th Street Bridge.

 NOW THEREFORE, BE IT RESOLVED, THAT THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO, DOES HEREBY RATIFY WATER COUNSEL'S APPLICATION TO CHANGE THE WATER RIGHT TO ADD AN ADDITIONAL POINT OF DIVERSION TO ALLOW THE USE OF THE WATER FOR CURRENTLY DECREED MUNICIPAL PURPOSES, AND FOR IRRIGATION USES RELATED TO TRAILS, PARKS, AND RIVERFRONT DEVELOPMENT.

 

The City's Utilities Manager and legal counsel are directed to take such steps as may be required to secure an alternate point of diversion.
