Clarifying the Applicability of Ordinance 2884
RECITALS:
On January 3, 1996 the City Council of the City of Grand Junction passed on second reading Ordinance 2884. Prior to passage, the Ordinance was amended to provide that it be applicable to those areas specified in the Ordinance and that it be applicable to the riverfront trails, a term that is not defined in Ordinance 2884. Following Council discussion, the City Attorney was directed to prepare a resolution confirming the jurisdiction of Ordinance 2884 as it relates to riverfront trails.
Ordinance 2606, codified at section 26-76 et. seq. of the Code of Ordinances, together with the regulations promulgated thereunder, defines the riverfront trails and incorporates a map of the trails.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
That this Resolution No. 12-96, confirms that Ordinance 2884 is and shall be applicable and enforced consistently with the terms of Ordinances 2884 and 2606, and all ordinances, resolutions and regulations not inconsistent therewith, at all places defined, depicted and referred to by section 26-76 et. seq. of the Code of Ordinances of the City of Grand Junction. Specifically, the Council adopts and affirms the provisions of section 26-76 of the Code of Ordinances and the definition of riverfront, riverfront trails or trails as those areas, facilities, lands and waters identified on the "Riverfront Map."
