 RESOLUTION NO. 98-15   (Town of Palisade)

 

 

JOINT RESOLUTION BETWEEN CITY OF GRAND JUNCTION CITY COUNCIL

(“CITY COUNCIL”) AND TOWN OF PALISADE (“BOARD OF TRUSTEES”)

REGARDING TRANSCOLORADO GAS TRANSMISSION PROJECT

 

 

 WHEREAS, the City of Grand Junction (“City”) and the Town of Palisade (“Town”) own fee lands on the Grand Mesa which are used individually and jointly as watershed areas for municipal water supplies; and

 

 WHEREAS, the City and Town watershed areas are comprised of not only Town and City property but also federally-administered public lands and other private land holdings; and

 

 WHEREAS, the Town has land use jurisdiction over the watershed areas pursuant to State statute and Town Municipal Code; and

 

 WHEREAS, the watershed areas are characterized by a variety of physiography including springs, seeps, landslides, steep rocky slopes, ravines, water supply pipelines, water collection systems, and ditches; and

 

 WHEREAS, the proposed TransColorado Gas Transmission Project crosses these watershed lands and will, by its heavy construction nature, have short and long-term impacts on the watersheds; and

 

 WHEREAS, the Town has a Watershed Permit process and the Federal permitting agencies have responsibility for approving the Project and insuring that stipulations in various Records of Decision are included in Project Plan of Development; and

 

 WHEREAS, the Town and the City have been involved in the review process; and

 

 WHEREAS, the Town and the City desire to continue to construct, maintain, and operate their individual municipal water collection and treatment systems independent of each other while jointly cooperating in protecting their municipal watershed.

 

 NOW, THEREFORE, IN CONSIDERATION OF THE ABOVE, THE BOARD OF TRUSTEES AND THE CITY COUNCIL RESOLVE:

 

* To jointly cooperate and consult with each other on proposed actions related to the Town’s issuance of the Palisade Watershed Permit, including the submission and review of appropriate review comments from the City,

 

* To act jointly in regard to reviewing and authorizing watershed permits and rights of way negotiations,

 

* To prepare and submit joint comments on the Supplemental Environmental Impact Statement and the Plan of Development,

 

* To insure that comments on the Supplemental Environmental Impact Statement, Plan Of Development and Town of Palisade Watershed Permit are communicated to the Federal authorizing agencies and are incorporated into the Record of Decision on the Supplemental Environmental Impact Statement and in the Final Plan of Development,

 

* To cooperate in and coordinate on an appeal of the Record of Decision on the Supplemental Environmental Impact Statement if the Record of Decision has not been adequately prepared for completeness and if the City and the Town’s comments on the Plan of Development are not adequately addressed and included in the final Plan of Development. Such appeal, if any, would be an individual decision of either municipal corporation,

 

* To appear at hearings before the Mesa County Planning Commission and the Mesa County Commission on TransColorado’s Mesa County Conditional Use Permit application,

 

* To continue to cooperate on joint staffing of hydrologic studies and pipeline construction inspections,

 

* To negotiate in tandem, and not separately, rights of way across Town and City lands and to jointly insure that project impacts on watershed areas are adequately insured and that the public owners of City and Town lands are adequately compensated for use of City and Town lands.

 

* To take all necessary action to fully inform FERC of actions that will affect private lands and to consider intervention in any administrative or Commission action that may affect the watershed areas.
