Resolution No. 50-98

 

VACATING AN UTILITY EASEMENT

 

Recitals:

 

 This resolution vacates an utility easement located at 2424 F Road. The easement contains no utility lines and the utility providers have indicated the easement is not needed. The easement crosses the center of the lot and must be vacated in order to allow construction of a building at the site.

 

 The Planning Commission, having heard and considered the request and found the criteria of the Code to have been met, recommends that the vacation be approved.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

1. The following described easement is hereby vacated:

 

A portion of an easement labeled as “10’ UTILITY EASEMENT” across Lot 1 of Home Depot U.S.A. Inc., a subdivision of Mesa County, Colorado, in the SW 1/4 of Section 4, Township 1 South, Range 1 West of the Ute Meridian, the plat of which is on file with the Mesa County Clerk and Recorder in Plat Book 16 at Pages 142 and 143. Said portion of said easement is more particularly described as follows:

 

Commencing at the Northwest corner of said Lot 1,

Thence along the West line of said Lot 1, South 00º06’21” East, a distance of 68.12 feet;

Thence North 90º00’00” East, a distance of 15.00 feet to the Point of Beginning;

Thence South 90º00’00” East, a distance of 111.49 feet;

Thence South 00º00’00” East, a distance of 10.00 feet;

Thence North 90º00’00” West, a distance of 111.51 feet;

Thence North 00º06’21” East, a distance of 10.00 feet to the Point of Beginning.
