A RESOLUTION AMENDING RESOLUTION NO. 50-96

ESTABLISHING FEES FOR PERMITS FOR WORK IN PUBLIC RIGHTS OF WAY AND ESTABLISHING RIGHTS OF WAY INSPECTION AND TESTING FEES

 

 

RECITALS.

 

In May 1996 the Council adopted Resolution 50-96. That Resolution established fees for permits for work in the public rights of way and inspection and testing fees for the work.

 

Under the provisions of Sections 32-8, 32-34, 38-166 and 38-169 of the Code of Ordinances of the city of Grand Junction, the City Council shall establish by resolution fees for permit(s) to perform certain kinds of construction and work within the rights of way. In addition, the City Council shall establish an hourly fee for inspection and testing of work performed by permittees in order to partially reimburse the City for the attendant costs. Resolution 50-96 did not establish an hourly fee but instead assigned cost based on the length of trench. Experience with that fee structure has shown that an hourly fee is likely more reflective of costs of inspection.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

That Resolution 50-96 is amended to provide that the fee for each and every work permit issued in accordance with Sections 32-8, 32-34 and 38-166 of the Code of Ordinances shall be $60.00, which fee shall include one hour of inspection and travel time. For work requiring more than one hour of inspection and travel time, the hourly rate shall be $40.00 billable to the nearest quarter hour.

 

The permit fee established by this resolution includes the cost of inspection but excludes the costs associated with testing as required by 38-169 of the Code of Ordinances. Testing shall be performed as indicated on the permit or as otherwise required by the Director of Public Works and Utilities or his designee. All required testing shall be conducted by a certified independent laboratory at the sole and absolute expense of the permittee.

 

Any conflicting and/or inconsistent provisions of resolution 50-96 are hereby repealed.
