VACATING A UTILITY EASEMENT

 

Recitals:

 

 This resolution vacates a utility easement located between Rood Avenue and W. Main Street in the vacated Rice Street right-of-way. The easement contains a 6-inch water line and a US West fiber optic communication line. The utilities will be relocated to in the new service road to the proposed Mesa County Justice Center and existing Detention Facility. This easement is being vacated so that an underground tunnel can be constructed from the present Mesa County Detention Facility to the proposed Mesa County Justice Center.

 

 The Planning Commission, having heard and considered the request and found the criteria of the Code to have been met, recommends that the vacation be approved.

 

 NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT:

 

1.  The following described easement is hereby vacated:

 

A utility and drainage easement in Lot 2 of the Mesa County Justice Center in Section 14, Township One South, Range One West of the Ute Meridian, City of Grand Junction, Mesa County, Colorado, more particularly described as follows:

 

Commencing at an alloy cap for the southeast corner of said Lot 2; thence N89º58’41”W, on the northerly right-of-way line of Main Street, for a distance of 174.27 feet to the point of beginning; thence N00ºo1’00”W 149.96 feet; thence N89º58’41” W 14.19 feet; thence N00º01’00”W 299.38 feet; thence S89º58’41”E 30.00 feet; Thence S00º01’00”E 250.36 feet; thence S32º18’46”E 26.55 feet; thence S00º01’00”E 166.74 feet to the point of beginning.
