VACATING A UTILITY EASEMENT

 

Recitals:

 

This resolution vacates the northern 2.5 feet of an 8-foot wide utility easement located on the south property line of Lot 1, Block 3, Filing No. 3 of Grand View Subdivision, 634 E. Pagosa Drive. All relevant utility companies have agreed to the vacation and the Staff recommends approval with the condition that the utility lines be moved to the agreed upon location prior to the vacation being effective.

 

The Planning Commission has heard and considered the request and found that the criteria of the Code has been met. The Planning Commission recommends that the vacation be approved.

 

NOW, THERE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION THAT;

 

1.  The following described easement is hereby vacated:

 

That portion of an existing 8 foot utility easement situated in Lot 1, Block 3, Filing 3 of the Grand View Subdivision, City of Grand Junction, County of Mesa, State of Colorado, being more particularly described as follows:

 

Commencing at a point which bears N00°00’43”E 5.50 feet from the Southeast corner of Lot 1, Block Three of said Grand View Subdivision, Filing No. Three; thence N89°58’12”W 84.97 feet; thence N14°41’33”W 2.58 feet along the East line of a 14 foot wide multi-purpose easement; thence S89°58’12”E 85.62 feet; thence S00°00’43”W 2.50 feet to the point of beginning for this portion of easement.
