RESOLUTION NO. 33-04

 

A RESOLUTION RELINQUISHING A FIRST RIGHT OF REFUSAL

TO PURCHASE REAL PROPERTY AT 402 GRAND AVENUE

FROM THE FIRST ASSEMBLY OF GOD CHURCH

 

Recitals.

 

A.  Pursuant to that certain Lease Agreement dated the 25th day of April, 2000, as authorized by Resolution No. 35-00, passed and adopted by the City Council on the 19th day of April, 2000, the City leases certain real property from the First Assembly of God Church for City employee parking purposes.

 

B.  Section Ten of the Lease Agreement provides the City a first right of refusal to purchase from the First Assembly of God Church all of the property located in the City block bounded by 4th Street, 5th Street, Grand Avenue and Ouray Avenue. The City’s first right of refusal to purchase the property is valid and legally binding through July 27, 2005.

 

C.  The City Council has determined that the City’s first right of refusal to purchase the above-described real property should be relinquished.

 

 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO, THAT:

 

The City, for good and valuable consideration, the sufficiency of which is hereby acknowledged, has unconditionally remised and released unto The First Assembly of God Church, the City’s first right of refusal to purchase the above-described real property as created under the above described Lease Agreement.
