ORDINANCE NO. 265
AN ORDINANCE ESTABLISHING NAMES FOR CERTAIN PARKS BELONGING TO THE CITY OF GRAND JUNCTION AND PRESCRIBING RULES FOR THE USE AND CARE OF THE SAME.
Be it ordained by the City Council of the City of Grand Junction, Colorado:
Section 1. That the City property situated at the west end of West Colorado avenue and described as Lots 12, 13, 14, 15, 19, 20 and 21, in Block 10, of Mobley's Subdivision of the City of Grand Junction, is hereby named and shall hereafter be known as Riverside Park.
Section 2. The City property situated east of Twelfth street and described as follows: The northwest quarter of the northwest quarter (NW1/4 NW1/4) of Section thirteen (13), Township one (1) South, Range one (1) West of the Ute Meridian, in Mesa County, Colorado, is hereby named and shall hereafter be known as Lincoln Park.
Sec. 3. The City Council may grant a license to any responsible person, organization, firm or corporation for permission to use Lincoln Park and the buildings, grand stand and race track therein for public entertainments, ball games or any other athletic games or sports, races, stock shows, fairs and public exhibitions; provided, such person, association, firm or corporation shall agree to obey and conform with all rules and regulations now made or that may hereafter be made by the city council in reference to the care, management and government of city parks.
Sec. 4. The person, association, firm or corporation using said Lincoln Park for any of the purposes named in section 3 of this ordinance, shall, in every case when an admission fee is charged, pay to the City of Grand Junction, ten per cent of the gross receipts from such entertainment, game, race, fair, show, or exhibition.
Sec. 5. Permission may also be granted by the Commissioner of Health and Civic Beauty, under the provisions of this ordinance, to erect any temporary buildings or tents for exhibition or other purposes, and any buildings or tents so erected shall be removed from said Lincoln Park by the owner or owners of such buildings or tents within five days after the close of such exhibition, fair or entertainment, and upon the failure of such owner or owners to remove such buildings within said five days every such building shall be and remain the property of the City of Grand Junction.
Sec. 6. All moneys derived by the City for the use of Lincoln Park as provided in this ordinance, shall be deposited with the city Treasurer, who shall credit the same to the General Fund.
Sec. 7. No person, association, firm or corporation shall advertise to hold or hold any entertainment, exhibition, fair, or other entertainment of any kind in Lincoln Park, where an admission is charged, without first securing a license therefor.
Sec. 8. The ordinances of the City of Grand Junction shall be in full force and effect in said Lincoln Park as though the said park were included within the limits of said city. The commission of any and all acts within said park are hereby forbidden, which are forbidden by ordinance within said city and under like penalties. The violation of any of said ordinances within the said park shall be prosecuted and punished in the Municipal Court of Grand Junction. The Commissioners and all policemen and firemen of said city shall have the same police power and authority within said park that they possess within the limits of said city.
Sec. 9. Any person violating any of the provisions of this ordinance upon conviction shall be fined not less than five dollars nor more than two hundred dollars for each offense.

I HEREBY CERTIFY, that the foregoing ordinance, entitled "An Ordinance Establishing Names for Certain Parks belonging to the City of Grand Junction and Prescribing Rules for the Use and Care of the Same," was introduced and read at a regular adjourned meeting of the city Council of the City of Grand Junction, Colorado, held on the 13th day of February, A. D. 1918, and that the same was published in full in the Daily News, a daily newspaper published and in general circulation in said city, at least ten days before its passage.
