ORDINANCE NO. 310

 

 

 An Emergency Ordinance providing for the collection and disposition of Garbage and the Cleaning of Grease Traps within the City of Grand Junction by Contract and repealing Ordinance No. 187, passed and adopted February 23rd, 1911, and repealing Section 1 of Ordinance No. 252 passed and adopted August 2nd, 1916 amending Sections 6 and 7 of Ordinance No. 187, and repealing all ordinances and parts thereof in conflict with this Ordinance.

 

 

 WHEREAS a special emergency has arisen whereby, in order to preserve and protect the public health in the City of Grand Junction, it has become necessary that the City of Grand Junction exercise a more direct supervision over the collection and disposition of garbage and the cleaning of grease traps.

 

 

 THEREFORE: Be it ordained by the City Council of the City of Grand Junction, Colorado:

 

 

 Section 1. The City Council may contract for the collection and disposition of garbage, and may also contract for the cleaning of grease traps within the City of Grand Junction.

 

 

 Section 2. The person with whom such a contract for the collection and disposition of garbage may be made shall be known as the City Garbage Collector. The person with whom such a contract for the cleaning of grease traps may be made, shall be known as the City Scavenger. It shall be the duty of the City Garbage Collector to take up and haul away garbage as defined by Ordinance No. 179, in accordance with the Ordinances of said City, and the terms of the contract to be made by the City of Grand Junction and such City Garbage Collector. It shall be the duty of the City Scavenger to clean grease traps and dispose of the contents thereof in accordance with the Ordinances of the said City, and the terms of the contract to be made between the City of Grand Junction and such City Scavenger.

 

 

 Section 3. No person other than the City Garbage Collector shall collect, take up, haul away or dispose of any garbage as defined by Ordinance 179, and no person or persons, partnership or corporation, shall permit any such garbage to be collected, taken up or hauled away from the premises owned or occupied by him, her, them or it, other than by the City Garbage Collector; provided, that any citizen of this City may with his own team or teams remove garbage from the premises owned or occupied by him, in the manner provided by the ordinances of the City of Grand Junction and under the direction and supervision of the City Manager.

 

 

 Section 4. No person other than the City Scavenger shall engage in the hauling away of trash, rubbish, night soil, the cleaning of privy vaults, cesspools or grease traps; provided that the provisions of this Ordinance shall not affect any citizen of this City, who shall with his own team or teams remove from the premises owned or occupied by him, any such refuse or material as herein contemplated, and in the manner provided by the Ordinances of the City of Grand Junction and under the direction and supervision of the City Manager.

 

 

 Section 5. The City Scavenger may clean cesspools, privy vaults and do work of like nature for persons within the City of Grand Junction, and for all such work, he shall not charge in excess of the amount fixed as a maximum in Section 12 of Article 3 of Ordinance 179.

 

 

 Section 6. The City Garbage Collector shall do the work of collecting and disposing of garbage under the supervision and direction of the City Manager. The City Scavenger shall do the work of cleaning all grease traps, privy vaults and cesspools under the direction and supervision of the City Manager.

 

 Section 7. All grease traps shall be cleaned out at least once in each year and oftener if necessary.

 

 

 Section 8. The owner or occupant of the premises where any grease trap is located, that is so cleaned by the City Scavenger, shall pay to the City Treasurer at the City Hall, for the City, the sum of one dollar for each cleaning of each grease trap 24 inches by 36 inches in size, or smaller, and two dollars for each cleaning of each grease trap larger than 24 inches by 36 inches in size; provided, however, that when any grease trap is located entirely or partly on premises not belonging to the owner of the house or building using such grease trap, then the above charge may be made against the owner or occupant of the house using such grease trap; and provided further, that the above charge is the rate made when the cleaning is done by the City Scavenger in his regular round of cleaning; that when a special trip is made to clean a grease trap at the request of or necessitated by the owner or occupant of the premises, an additional dollar shall be added to the above charge.

 

 

 Section 9. All money for cleaning of grease traps by the City Scavenger shall become due and payable on the first day of January, April, July and October of each year, next ensuing the time of cleaning the said grease traps as herein provided, and if not paid within thirty days after the same shall become due, the city water shall be shut off from the house or premises that is connected with and uses the grease trap, the charge for cleaning of which has not been paid. Whenever the city water shall be shut off on account of the non-payment of the charge for cleaning grease traps, it shall not again be turned on until the said charge and one dollar additional to compensate for the trouble and expense of turning off and on the water shall have been paid.

 

 

 Section 10. The City Manager, his duly authorized Deputy, or subordinate and the City Scavenger are hereby vested with authority to enter into and upon any premises, either public or private, for the purpose of inspecting and cleaning grease traps throughout the City, and any person or persons resisting or refusing to permit the inspection or cleaning of any grease trap, as in this Ordinance provided, shall upon conviction be fined in a sum of not less than five dollars nor more than one hundred fifty dollars, or be sentenced to the City Jail for not exceeding ninety days for each offense.

 

 

 Section 11. Any person who shall violate any of the provisions of this ordinance, upon conviction thereof, shall be punished by fine of not less than five dollars nor more than one hundred fifty dollars, or by imprisonment in the City Jail for a period not exceeding ninety days.

 

 

 Section 12. That Ordinance No. 187 passed and adopted February 23, 1911, entitled "An Ordinance providing for the collection and disposition of garbage and the cleaning of grease traps within the City of Grand Junction by contract and fixing the license fee of Scavenger", and Ordinance No. 252, passed and adopted August 2nd, 1916, and entitled, "An Ordinance amending Sections 6 and 7 of Ordinance No. 187 and repealing Ordinance No. 151, be and the same are hereby repealed.
