ORDINANCE NO. 319

 

 

 AN EMERGENCY ORDINANCE CONCERNING BUILDINGS AND STRUCTURES, OTHER THAN RESIDENCES AND THE NECESSARY OUTBUILDINGS USED IN CONNECTION THEREWITH, IN THE RESIDENTIAL DISTRICT OF THE CITY.

 

 

 Be it ordained by the City Council of the City of Grand Junction, Colorado:

 

 

 Section 1. That no person or persons, association, corporation or partnership shall erect or construct or cause to be erected or constructed any building or structure, other than for a residence and the necessary outbuildings used in connection therewith, in the residential district of the City of Grand Junction, without first obtaining a permit therefor from the City Council.

 

 

 Section 2. By residential district is meant all that part of the City of Grand Junction outside of the fire limits of said City.

 

 

 Section 3. Said application shall be in writing and shall state the kind of building or structure to be built; the estimated cost thereof and the nature of use to be made of same.

 

 

 Section 4. If a majority of the property owners owning property in the following described area, to-wit: In the block wherein said contemplated building or structure is to be erected, and in the block across the street and facing the land on which said contemplated building or structure is to be erected, or in the event the land across the street and facing said land on which said contemplated building or structure is to be erected is outside of the City limits, then the majority of the property owners owning property in the block wherein said contemplated building or structure is to be erected, shall, within 15 days from the time said application is presented to the City Council for said permit, file a written protest to said application, with the City Clerk, who shall present same to the City Council at its next meeting, then, if in the judgment of the City Council good grounds exist for refusing said permit, said application shall be denied and no permit issued.

 

 

 Section 5. The provisions of this ordinance shall not apply to school buildings or private residences and the necessary outbuildings used in connection therewith.

 

 

 Section 6. Any person or persons, association, corporation or partnership violating the provisions of this ordinance, shall be deemed guilty of an offense and upon conviction thereof shall be fined not less than $5.00 nor more than $150.00, and each day such person or persons, association, corporation or partnership shall work or cause work to be done on said building or structure, without first obtaining such permit, shall be deemed a separate offense.

 

 

 Section 7. This ordinance is passed because of a special emergency for the preservation of the public peace and safety, and shall go into effect upon its passage.

I HEREBY CERTIFY that the foregoing ordinance entitled, "An emergency ordinance concerning buildings and structures, other than residences, and the necessary outbuildings used in connection therewith, in the residential district of the City", was introduced, passed and adopted as an emergency ordinance and numbered 319, and ordered published in full in the Daily News, by the City Council of the City of Grand Junction at a regular meeting held on the 31st day of May, A.D. 1922.
