ORDINANCE NO. 321
AN ORDINANCE ACCEPTING THE MOYER POOL IN LINCOLN PARK AND PROVIDING REGULATIONS FOR THE USE AND MAINTENANCE THEREOF.
WHEREAS, William J. Moyer and Ida Moyer did on the 31st day of May, 1922 by an instrument of writing present to the City of Grand Junction, the Moyer Pool, situate in Lincoln Park; and
WHEREAS, the thought and desire of the donors in building and presenting the Pool to the City of Grand Junction was that the youth of Grand Junction and the surrounding territory may be benefited thereby; and
WHEREAS, said gift was made on the following conditions, to-wit:
1. That the Pool shall be forever maintained and run by the City of Grand Junction.
2. That the use of the Pool on Wednesdays and Saturdays between 9:30 o'clock A.M. and 5:30 o'clock P.M. of each week during the bathing season shall forever be free to children under sixteen years of age.
3. That, except as above noted, a reasonable charge shall be made for the use of the Pool in order to receive funds to pay for the expenses of its maintenance. The donors are opposed, however, to charging at any time exorbitant fees for its use, or running the Pool for the purpose of making a profit to the City.
CERTIFICATES of DEPOSIT
4. Should the Pool be used in the winter time for skating purposes the above conditions as to two free days for children under sixteen years of age, and as to charges, shall govern.
5. The use of the wading pool and sand beach shall be free at all times when the pool is in use;
NOW THEREFORE; Be it ordained by the City Council of the City of Grand Junction:
Section 1. That the said City does hereby accept the said Moyer Pool upon the terms and conditions set out in the said written conveyance from the said William J. Moyer and Ida Moyer to the City of Grand Junction, and does hereby agree to perform all of the obligations and conditions required of the said City by said written conveyance.
Section 2. That the use of the Pool shall be forever maintained and run by the City of Grand Junction.
Section 3. That the use of the Pool on Wednesdays and Saturdays between the hours of 9:30 o'clock A.M. and 5:30 o'clock P.M. of each week during the bathing season shall forever be free to children under sixteen years of age.
Section 4. That the use of the wading pool and sand beach shall be free at all times when the pool is in use.
Section 5. Should the Pool be used in the winter time for skating purposes, children under sixteen years of age shall be permitted to use the same on Saturdays and one other day to be designated by the City Council, between the hours of 9:30 o'clock A.M. and 5:30 o'clock P.M. of each week during the time said pool is used for skating purposes, free of any charge.
Section 6. That for the use of the pool during the bathing season the following charges shall be made: For all persons over sixteen years of age for use of pool and towel, 25 cents and war tax; for rental of bathing suit, 15 cents; for all children under sixteen years of age, for use of pool and towel, 15 cents and war tax, except on Wednesdays and Saturdays between 9:30 o'clock A.M. and 5:30 o'clock P.M. of each week during the bathing season, when the use of said pool is free; for rental of bathing suits, 10 cents.
Section 7. It shall be unlawful for any person to write upon or disfigure, damage, mar or injure said pool or the buildings used in connection with said pool, or any of them, or use said pool while drunk or intoxicated, or conduct himself or herself improperly, and upon conviction thereof, shall be fined in a sum of not less than $5.00 nor more than $150.00.
Section 8. There is hereby created a special fund known as the Moyer Pool Fund, and all accounts, income, receipts and disbursements of said Pool, buildings and business in connection therewith, beginning with the 8th day of June, 1922, shall be kept separate and distinct from the accounts of any other department, and shall be used only for and on account of said Pool, buildings, business and grounds in connection with said Pool.

I HEREBY CERTIFY that the foregoing ordinance entitled, "An ordinance accepting the Moyer Pool in Lincoln Park and providing regulations for the use and maintenance thereof" was introduced and read at a regular meeting of the City Council of the City of Grand Junction held on the 7th day of June A.D. 1922, and ordered published in the Daily News, a daily newspaper published and in general circulation in said city at least ten days before its passage.
