ORDINANCE NO. 364.

 

AN ORDINANCE CREATING WHAT IS TO BE KNOWN AS "THE MUNICIPAL CEMETERY" AND PROVIDING FOR PERPETUAL MAINTENANCE THEREOF.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That there is hereby created a municipal cemetery, consisting of land owned by the City of Grand Junction and to be known and designated as "The Municipal Cemetery." No grave-plots or lots therein shall be used or sold until the plat or plats of said municipal cemetery shall have been placed on file in the office of the County Clerk and Recorder of Mesa County, Colorado.

 

 Section 2. Lots and grave plots in the municipal cemetery will be conveyed to the purchaser by warranty deed, subject to the rules and regulations, and ordinances of said city in reference to said cemetery, and the laws of the State of Colorado.

 

 Section 3. The City Clerk of the City of Grand Junction shall keep all records of the said municipal cemetery and shall have charge of the sale of lots and grave plots therein.

 

 Section 4. All lots and grave sections therein shall be held in accordance with and subject to the rules, regulations and ordinances of the City of Grand Junction and the laws of the State of Colorado.

 

 Section 5. The City of Grand Junction shall perpetually care for and maintain all roads, walks, pathways, grass, ground and shrubbery and improvements belonging or appertaining to said cemetery; provided, however, that all lots or grave section owners are to care for and maintain all monuments, mausoleums and markers erected on their lots or grave tracts.

 

 Section 6. The maintenance and improvement of said municipal cemetery shall be in charge of the City Manager.

 

 Section 7. Single grave sections will be sold in block 7 of the municipal cemetery. However, there will be no choice of location unless a full lot is purchased. In order to maintain a park-like appearance, no monuments raised above the surface of the ground will be allowed in block 7 and all markers and head-stones must be set level or flush with the ground.

 

 Section 8. In block 6 of the municipal cemetery one monument for each two grave sections will be permitted. Monuments shall be placed only in the center of a plot at the place reserved for same. No monument, mausoleum or other structure shall be placed in the municipal cemetery until a design of same, with specifications, has been submitted to and approved by the City Manager. Plots in block 6 will be sold in groups of not less than two grave sections.

 

 Section 9. The price of lots shall be at the rate of $25.00 per grave section, four feet by ten feet, and $25.00 for each grave section four feet by ten feet for perpetual care. No burial shall be permitted in said municipal cemetery unless the grave section is fully paid for, including the perpetual-care fee.

 

 Section 10. No lot or grave section may be decorated by its owner or others with any trees or shrubs, nor shall the trees or shrubs already or hereafter to be planted thereon by the City of Grand Junction be disturbed in any way.

 

 Section 11. No lots or parcels of ground or grave sections in said municipal cemetery may be defined or marked by any fence, coping, railing, hedge or embankment, nor shall any lot be filled above the established grade. Boundaries of lots or grave sections may be designated if the owner so desires, by granite corners set level or flush with the ground and inside the corner of the lot or lots or grave sections so marked. Boundary markers as herein provided shall be placed and maintained at the expense of the owner of said lot or/grave section.

 

 Section 12. Grave markers of granite or bronze, set level or flush with the lawn, may be placed at the head of each grave. Foundations will be required for all monuments, mausoleums and structures of every description placed on lots, said foundations to be constructed by the City of Grand Junction, the rates to be fixed and established by resolution of the City Council. No foundations will be required for flat markers. All orders for foundations must be filed at the office of the City Clerk and payment thereof made to the City Treasurer. Endowments for the special care of any particular lot or lots may be made to the City of Grand Junction and the income therefrom will be used for such special care, not inconsistent with the ordinances, rules and regulations of said cemetery, as the donor may designate.

 

 Section 13. All money received from the sale of lots or plots or grave tracts in said cemetery shall be used for the improvements of said cemetery. All money received for perpetual care shall be invested by the City Treasurer at the direction of the City Council in Grand Junction municipal or United States government bonds and all interest derived therefrom shall be used in the care and maintenance of said cemetery.

 

 Section 14. All needed rules and regulations for said cemetery shall be made by resolution by the City Council of the City of Grand Junction.
