ORDINANCE NO. 390.

 

WHEREAS THE SEWER IN THE ALLEY RUNNING NORTH & SOUTH BETWEEN 6TH & 7TH STREETS AND BETWEEN PITKIN AND HILL AVENUES IN THE CITY OF GRAND JUNCTION IS BUT SIX INCHES IN DIAMETER AND IS INADEQUATE TO CARRY OFF ANY UNUSUAL AMOUNT OF WATER AND WASTE DISCHARGED THEREIN, AND IT HAS BECOME NECESSARY TO MORE FULLY REGULATE THE USE OF SAID SEWER FOR THE PRESERVATION OF THE PUBLIC HEALTH AND SAFETY.

 

 THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO.

 

 Section 1. That the connection of so called "Hopper" toilets with the sewer system, the main line of which is located in the alley running North & South between 6th & 7th Streets and between Pitkin & Hill Avenues in the City of Grand Junction, is hereby prohibited, and any and all "Hopper" toilets now connected therewith shall be removed within 30 days after the passage of this ordinance, or replaced within such time with so-called "Flushing" toilets.

 

 Section 2. That all wash racks or drain racks connecting with said sewer as described in Section 1 hereof shall be immediately equipped with sand and waste traps with openings therein not to exceed two inches in diameter, and no sand or waste or other material shall hereafter be permitted to enter said sewer or sewer system through said racks except such as may pass through such traps, and that said traps shall never be cleaned in such a manner as to permit the accumulations therein to pass into said sewer or said sewer system.

 

 Section 3. Any person, firm or corporation violating any of the provisions of this ordinance shall upon conviction be fined in a sum not less than $10.00 and not more than $300.00 for each offense, and every 24 hours that any such person, firm or corporation shall fail, neglect or refuse to comply with the terms and provisions of this ordinance shall constitute a separate offense hereunder.

 

 Section 4. That in the opinion of the City Council a special emergency exists for the preservation of the public health and safety, and this ordinance shall therefore go into effect upon it's passage.
