ORDINANCE NO. 391

AN ORDINANCE CONCERNING ASHES; THE STORAGE AND DEPOSIT THEREOF IN RECEPTACLES & PITS: THE REQUIREMENTS OF CONSTRUCTION OF ASH PITS AND RECEPTACLES FOR ASHES AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLO:

 

 Section 1. It shall be the duty of the owner of every building and of the agent having the control of the same or being in charge of the same to furnish a close and secure metallic or earthen vessel or brick room or bin as a receptacle for ashes; and no ashes (except at manufacturies where ashes are used) shall be kept or deposited in anything other than such metallic or earthen vessel or stone or brick room or bin.

 

 Section 2. All receptacles for ashes shall be built of brick, stone or other incombustible materials with walls not less than eight inches thick, with proper iron doors, the doors to be kept in repair and to be closed when not being used to empty said pits, and said pits shall be constructed on the alley line of said property so that the same may be emptied from the alley. No receptacles for ashes shall ever be allowed to overflow or be so constructed that the ashes will be blown about by the wind. When ash cans are used they must have double bottoms with a space of at least two inches between the covers secured with iron hinges, and the cans at all times to be in proper repair, the lid to be closed when not being filled or emptied.

 

 Section 3. It shall be unlawful for any person to set fire to any rubbish, debris or waste material of any kind, upon any street, alley or lot, within the fire limits of this city, as the same are established or may hereafter be established by ordinance, except within the receptacles provided in Section 1 hereof; and it shall be unlawful for any person to set fire to any such material within forty feet of any building, outside of such fire limits within the limits of said city. All fires which may be lighted for the burning of any such material outside of said fire limits shall be extinguished or caused to be extinguished by the person lighting the same, before nine o'clock p.m., on the same day which they were lighted.

 

 Section 4. Any person failing to comply with, or violating any of the provisions of this ordinance shall be fined in a sum not less than $2.00 nor more than $100.00, and the additional sum of $5.00 for every 24 hours of failure or refusal to supply such receptacle after notice to do so from the Chief or Assistant Chief of the Fire Department or any police officer.

 

 Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
