ORDINANCE NO. 397

 

AN ORDINANCE AMENDING SECTIONS 2, 4, 5, 8 and 12 OF ORDINANCE NO. 238 PASSED AND ADOPTED AUGUST 10, 1915, AS AMENDED BY ORDINANCE NO. 347 PASSED AND ADOPTED JANUARY 30, 1924.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That Sections 2, 4, 5, 8 and 12 of Ordinance No. 238 of the City of Grand Junction, passed and adopted August 10, 1915, as amended by Ordinance No. 347 of the City of Grand Junction, passed and adopted January 30, 1924, be and the same are hereby amended so as to read as follows:

 

 Section 2. All annual license fees shall be paid in advance; no license shall be granted at any time for a longer period than one year, and every license shall expire on or before the last day of December next following the issuance thereof, and in all cases the period or term of the license shall be expressed therein.

 

 Section 4. No licenses shall be assigned or transferred nor shall any such license authorize any person to do business or act under it other than the person, persons, association or corporation named therein.

 

 Section 5. All license certificates shall be issued under the seal of the city, be signed by the City Manager and City Clerk and shall be as nearly as possible in the following form:

 This license may be suspended or revoked as provided by Ordinance.

 Section 8. No person, persons, association or corporation in this city shall conduct, carry on, or engage in any business, avocation or calling in this ordinance named without first obtaining a license therefor and shall pay for such license the sum or sums as hereinafter specified, viz:

 

1. Street Hawkers $20.00 per day (the word hawker as herein referred to is defined as being a salesman who cries his goods and sells the same on a public street).

 

 2. Street Peddlers carrying pack articles $100.00 per annum or portion thereof.

 

 Peddlers with one or two horse wagon, automobile or any other kind of vehicle for the purpose of peddling or selling any article of merchandise other than foodstuffs and soft drinks, $200.00 per annum or portion thereof.

 

 Peddlers with one or two horse wagon, automobile, or any other kind of vehicle for the purpose of peddling or selling foodstuffs and soft drinks, $50.00 per annum or portion thereof.

 

 3. For stands on private property for the sale of foodstuffs, soft drinks and novelties during the Mesa County Fair or other special occasions where large crowds congregate in the city (not including street hawkers or peddlers) $2.50 per day.

 

 4. For stands on public streets and thoroughfares for the sale of magazines and papers, the sum of $36.00 per annum; for stands on public streets and thoroughfares for the sale of peanuts and popcorn, the sum of $50.00 per annum; for stands on public streets and thoroughfares for the sale of any other foodstuffs, soft drinks or novelties, the sum of $100.00 per annum. This section shall not include hawkers nor peddlers.

 

 5. Striking machines, lifting machines, exhibitions on the street or other amusements not herein enumerated on or adjacent to streets, in all cases where charges are made by parties holding such amusements or managing such machines, $50.00 per annum or portion thereof.

 

 6. For gasoline pumps located on any public street or alley where gasoline is sold at retail the sum of $5.00 per annum for each gasoline pump.

 

 7. Shooting galleries, $100.00 per annum or portion thereof.

 

 8. Merry-go-round, Ferris wheel or similar amusement devices, $5.00 per day except during the week of the Mesa County Fair or other special occasions when large crowds congregate in the city, at which time the licenses shall be the sum of $10.00 per day.

 

 9. For halls, theatres, opera houses or other places of amusement for the exhibition of theatrical performances, musical concerts, shows or exhibitions by travelling performers and for all other shows, exhibitions and performances, including roller skating rinks, etc. (circuses and menageries excepted) license may be issued to any proprietor, or manager of any such hall, theatre, opera house, rink or other place of amusement upon the payment of $50.00 per annum; provided that this section shall not apply to Lyceum Courses supported by public subscription or entertainments for the benefit of charitable, religious, fraternal or educational institutions nor to entertainments, exhibitions and shows hereinafter listed.

 

 10. Circus menageries or circuses and menageries, or trained animal shows under canvas, shall pay license fees as follows:

 

 "A" - One ring, $50.00 per day; two rings, $100.00 per day; three rings or more $150.00 per day.

 

 "B" - For each side show or traveling exhibition accompanying any of the above mentioned shows for which an extra charge is made thereto (whether under the same management or not) the sum of $15 per day for each side show or exhibition.

 

 11. For theatrical, vaudeville or other entertainments under canvas, $20.00 per day where one performance on said day is to be given and $5.00 for each additional performance given on said day. Street fairs or carnivals, $10.00 per day for each separate tent or booth except during the week of the Mesa County Fair or other special occasions when large crowds congregate in the city, at which time the license shall be $20.00 per day for each separate tent or booth.

 

 Section 12. Auctioneers who auction new or unused goods, chattels, wares and merchandise shall pay a license fee of $200.00 per annum or for any portion of one year. Auctioneers who auction second-hand or used goods, chattels, wares and merchandise exclusively and live stock, $75.00 per annum or for any portion thereof.

 

 An auctioneer duly licensed hereunder to auction and sell new or unused goods, chattels, wares and merchandise shall have the right to comduct sales of used or second-hand goods, wares and merchandise, and no provision of this ordinance shall be considered to apply to sales made at public auction under and by virtue of any legal process or proceedings through or from a court of law nor to sales under mortgage or trust deed or to any tax sales or to sales made by any persons required by law to sell property by auction or sales made under ordinances of this city by any municipal officer.

 

 It shall be unlawful for any person, firm or corporation to sell any goods, wares or merchandise at public auction or to conduct an auction sale within the City of Grand Junction except on week days between the hours of 8 o'clock a. m. and 6 p.m.

 

 A license shall not be issued to any auctioneer until he shall have given or unless he has given for the then current year a good and sufficient bond to the City of Grand Junction in the sum of $500.00 to be approved by the City Council of said city and conditioned upon such auctioneer observing the laws of Colorado and the Ordinances and Charter of the City of Grand Junction.

 

 Section 2. All ordinances or parts of ordinances in conflict herewith, and particularly section 1 of Ordinance No. 250, passed and adopted May 31, 1916, are hereby expressly repealed.
