ORDINANCE NO. 423

 

AN ORDINANCE REGULATING THE SALE, STORAGE, DISTRIBUTION, DISCHARGE, AND FIRING OF FIREWORKS AND OTHER PYROTECHNIC DISPLAY.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION COLORADO, AS FOLLOWS:

 

Section 1. That no person, firm or corporation shall, within the City of Grand Junction or within one mile of the outer boundaries thereof, sell or offer for sale at retail or distribute any firecrackers, squibs, rockets, torpedoes, Roman candles, fire balloons, or other fireworks or substances designed and intended for pyrotechnic display, nor any pistols, canes, or cannons, or other appliances using blank cartridges or caps containing chlorate of potash mixture.

 

Section 2. No person shall, within the City of Grand Junction or within one mile of the outer boundaries thereof, nor within the public parks belonging to said City, fire or discharge any cannon, gun, fowling piece, pistol or firearms of any description, or fire, explode or set off any firecrackers, squibs, rockets, torpedoes, Roman candles, fire balloons, or other fireworks or substances designed and intended for pyrotechnic display, nor any pistols, canes, cannons or other appliances using blank cartridges or caps containing chlorate of potash mixture or other explosive or combustible material, without permission in writing from the City Manager of said City (which permission shall be granted only to properly qualified individuals or associations), and such display shall be under the direct supervision of experts in the handling of fireworks and shall be of such a character and so located, discharged or fired as, in the opinion of the Chief of the Fire Department, shall not be hazardous to surrounding property or endanger any person or persons, and such permission shall be subject to be revoked by the City Manager at any time after the same has been granted.

 

Section 3. The storage or sale of fireworks at wholesale is prohibited except by permit from the City Manager issued for a period of one year. Application for permit must be filed with the Chief of the Fire Department previous to the issuing of the permit, and must give detailed description of the proposed care and storage of said materials and the structural conditions and occupancies of the building. Permits may be issued only after an inspection of the premises by the Chief of the Fire Department or his authorized agent, who shall file with the City Manager a certificate of his approval or his disapproval and his reasons therefor. The Chief of the Fire Department shall direct such fire appliances as in his judgment may be necessary for the premises, and he shall see that one or more persons are instructed in their use and as to the best means of getting fire alarms to the Fire Department.

 

Section 4. Any person, firm or corporation violating any of the provisions of this ordinance as regards the storage and sale of fireworks shall, upon conviction thereof, be fined not less than Ten Dollars ($10.00) nor more than Twenty-five ($25.00) Dollars for each day's neglect of compliance. Any person, firm or corporation violating any other section or provision of this ordinance shall, upon conviction, be fined not less than One ($1.00) Dollar nor more than Fifty ($50.00) Dollars for each offense.

 

The Chief of the Fire Department may, at his discretion, remove or have removed at the owner's expense all stocks of fireworks or other combustibles exposed for sale or held in stock in violation of this ordinance.

 

Section 5. All ordinances and parts of ordinances inconsistent herewith are hereby repealed.
