ORDINANCE NO. 464
AN ORDINANCE PROVIDING FOR THE PAYMENT OF THE COSTS AND EXPENSES (EXCEPT ATTORNEYS' FEES) IN PROSECUTING A WRIT OF ERROR FROM THE DISTRICT COURT OF MESA COUNTY, COLORADO, TO THE SUPREME COURT OF COLORADO, IN THE CASE OF T. E. THOMPSON, ET AL. VS. BOARD OF COUNTY COMMISSIONERS, ET AL., SAID CAUSE BEING NUMBERED 4909
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
SECTION 1. WHEREAS The City of Grand Junction has an interest in the case of T. E. Thompson, et al. vs. Board of County Commissioners, et al, being cause No. 4909, in the District Court of Mesa County, Colorado, involving the sale of tax certificates upon which the city holds liens for special improvement taxes;
AND WHEREAS It has been determined by the plaintiffs in said action to prosecute a writ of error to the Supreme Court of the State of Colorado from the judgment of said District Court;
AND WHEREAS Such determination was made after the passage of the annual appropriation ordinance, and no specific provision has been made for the costs and expenses of prosecuting said writ of error, and an unforseen contingency has arisen after the passage of said annual appropriation ordinance;
THERE IS HEREBY APPROPRIATED Out of the Contingent fund of the City of Grand Junction the sum of $500.00, or so much thereof as may be necessary to defray the costs and expenses (except attorneys' fees) to prosecute a writ of error from the District Court of Mesa County, Colorado, to the Supreme Court of Colorado, in the case of T. E. Thompson, et al vs. Board of County Commissioners, et al., being cause numbered 4909 in said District Court.
SECTION 2. The payment of all sums heretofore made out of said fund for said purposes is hereby ratified, confirmed and approved.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 464, was introduced, read, and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 5th day of March, A. D. 1930, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said city at least ten days before its final passage.
