ORDINANCE NO. 474

 

AN ORDINANCE TO PREVENT FIRE HAZARDS BY REGULATING

THE USE OF ARTIFICIAL LIGHTING APPARATUS IN HOME PORTRAIT PHOTOGRAPHY IN THE CITY OF GRAND JUNCTION

 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

SECTION 1. That the term "home portrait photographer" as used in this ordinance is hereby defined to be any person, firm or corporation generally and professionally engaged in the business of photographic portraiture for hire, who employs portable photographic apparatus and equipment, in any building in the City of Grand Junction, for the purpose of making negatives used in the production of photographic portraits, miniatures, etc.

 

SECTION 2. That it shall be unlawful for any person, firm or corporation to engage in the business of home portrait photography, which necessitates the use of any artificial lighting apparatus within the corporate limits of said City of Grand Junction, until the provisions of this ordinance are complied with.

 

SECTION 3. That any person, firm or corporation desiring to engage in the business of home portrait photography, as herein defined, and to use any photographic artificial lighting apparatus in any home, room, residence, building, hotel or any other structure, either public or private, within the corporate limits of said City of Grand Junction, shall make application in writing, together with a deposit of the necessary inspection fees, to the City Clerk of said City, for a license to do so. Such application shall state the name and residence of the applicant, and, if the applicant is not to conduct the business himself, the names and addresses of any agents or servants who are to carry on the work, and the address where any such apparatus may be inspected, and shall also contain the names of two residents of this City as references who may be consulted regarding the reliability and character of the applicant, also the length of time for which the permit is desired, and a full description of the lighting apparatus to be used. Where electrical or flash-light apparatus is specified, such application shall be first approved by the City Manager of said City. After such application is approved, it shall be given to the City Clerk, accompanied by the license fee and a bond in the penal sum of $1,000.00, conditioned that any person suffering personal or property damage as a result of the use of such artificial lighting apparatus shall have a right of action on the bond of said applicant. Upon the filing of such application and bond and the approval of such bond by the City Council of said City, the license shall be issued by said Clerk to the applicant, to begin business, not less, however, than thirty days from the after applying for said permit, which shall be personal to the applicant, and shall expire on December 31st next thereafter, and no agent or employee shall carry on such work unless his name appears on such application or until a separate permit is obtained for such agent or employee. Any such permit may be renewed on December 31st of each year by renewing the bond and paying an annual license fee of $5.00.

 

SECTION 4. That the license fee shall be $5.00 and the inspection fee shall be $2.00, which inspection fee shall be retained to cover the cost of inspection whether or not such application is approved.

 

SECTION 5. That any person, firm or corporation that violates any of the provisions of this ordinance shall on conviction thereof be fined in any sum of not less than $10.00 nor more than $100.00, and each day during which any person, firm or corporation engages in the business of home portrait photographer in violation of this ordinance shall constitute a separate offense.
