ORDINANCE NO. 492

 

AN EMERGENCY ORDINANCE PROVIDING FOR THE PREVENTION OF INFECTION FROM RABIES AND REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT THEREWITH.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

SECTION 1. That whenever, in the opinion of the City Physician of the City of Grand Junction, the public health and safety of the people of said city require that dogs and cats be immunized by vaccination against rabies, the City Manager of said City shall issue a proclamation to that effect.

 

SECTION 2. Upon the issuance of such proclamation, it shall be unlawful for any person to own or harbor any dog or cat in the City of Grand Junction that has not been properly immunized by vaccination against rabies; provided that any dog or cat not immunized as hereinafter provided shall be kept in a pen or other confining quarters from which it is impossible for such dog or cat to escape.

 

SECTION 3. The inoculation with the proper vaccine for the prevention of infection from rabies shall be performed by a licensed veterinarian, who shall issue to the owner or keeper of such dog or cat a certificate showing the inoculation thereof and the date, which shall be exhibited by the owner to any police officer of said City, upon request. The fees for such inoculation shall be paid by the owner or keeper of such dog or cat. Such veterinarian shall, without additional charge, also furnish such owner or keeper a tag to be attached to the collar of such dog, and it is hereby made the duty of the owner or keeper of such dog to securely attach such tag to the collar of such dog.

 

The word "dog", as used in this ordinance, embraces both male and female of the canine species.

 

SECTION 4. It shall be the duty of any police officer to kill any unmuzzled dog running at large in said City, not displaying the inoculation tag provided in this ordinance.

 

SECTION 5. All cats within the City shall be confined by the owner or keeper for such time as may be designated in said proclamation, and it shall be the duty of any police officer to kill any cat running at large during such time.

 

SECTION 6. Any person violating any provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be punished by a fine of not less than five dollars ($5.00) nor more than one hundred dollars ($100.00) for each offense, and the cat or dog of any owner or keeper violating this ordinance shall be killed.

 

SECTION 7. All ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

SECTION 8. That in the opinion of the City Council a special emergency exists for the preservation of the public health and safety, and this ordinance shall therefore go into effect upon its passage.
