ORDINANCE NO. 509

 

AN ORDINANCE TO LICENSE AND REGULATE THE DELIVERY AND SALE OF ICE, AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

 SECTION 1. No person, firm or corporation shall deliver, sell or offer for sale within the City of Grand Junction, any ice to be used for drinking purposes, or in any way for human consumption, a fair sample of which has been inspected by a competent inspector of said City and found to be injurious or dangerous to health.

 

 SECTION 2. All persons, firms or corporations desiring to deliver, sell or offer for sale any ice within the City of Grand Junction, shall first file with the City Manager of said City, a sworn statement, specifying the locality at which such ice was cut, and the time when it was cut. If, upon inspection of such ice, the City Manager shall be satisfied that it is not fit to be used for human consumption, he shall require such person, firm or corporation, before bringing any such ice into said City, to give bond to said City in the sum of $1,000.00, conditioned that such person, firm or corporation will not violate any of the provisions of this Ordinance, and to obtain a permit therefor. Any person bringing ice into this City without first having made such statement or having given such bond or obtained such permit, shall upon conviction, be fined not more than $100.

 

 SECTION 3. No person, firm or corporation shall engage in the business of delivering ice to customers within the City of Grand Junction without first having obtained a license therefor from the City Clerk of said City, for which the license fee shall be the sum of $10.00 per year for each wagon or other vehicle to be used in making such delivery.

 

 SECTION 4. Any and all licenses issued in compliance with the requirements of this ordinance shall be issued in the manner and form, and subject to the conditions and limitations, prescribed by Sections 1 to 6, inclusive, of Ordinance No. 238, as amended by Ordinance No. 397, of the City of Grand Junction, and any subsequent amendments thereof.

 

 SECTION 5. Any person, association of persons, firm or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be punished by a fine in the sum of not more than $100.00 and costs, for each offense; and each day that any person, association of persons, firm or corporation shall violate any of the provisions of this ordinance shall be deemed a separate offense.

 

 SECTION 6. The City Council is of the opinion and finds, determines and declares that this Ordinance is necessary for the preservation of the public health and safety, and that a special emergency exists therefor; and this Ordinance shall therefore be effective and in force from and after its adoption and passage.
