ORDINANCE NO. 565
AN ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO. 89 AS AMENDED BY ORDINANCE NO. 395 OF THE CITY OF GRAND JUNCTION (SECTIONS 673 AND 677, REVISED GENERAL ORDINANCES OF 1928), RELATING TO THE PUBLIC LIBRARY, REPEALING ALL STATUTES OF THE STATE OF COLORADO AND ORDINANCES OF THE CITY OF GRAND JUNCTION IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
SECTION 1. That Section 1 of Ordinance No. 89, as amended by Ordinance No. 395 of the City of Grand Junction (Section 673, Revised General Ordinances of 1928), be and the same is hereby amended to read as follows:
Sec. 1 - That there be and there is hereby established a public library and reading room, for the use and benefit of the inhabitants of the City of Grand Junction, Colorado. Except as herein otherwise provided, such library and reading room shall be maintained and managed in accordance with the provisions of the act of the Twelfth General Assembly of the State of Colorado, approved April 10, A. D. 1899, and in accordance with Ordinance No. 82 of this city.
SECTION 2. That Section 5 of said Ordinance No. 89, as amended, (Section 677, Revised General Ordinances of 1928), be and the same is hereby amended to read as follows:
Sec. 5. Such board of directors shall constitute a body corporate by the name and style of "The Board of Directors of the Public Library of the City of Grand Junction," and in that name shall have such powers as are now, or may hereafter be conferred on it by statutes of the State of Colorado, or ordinances of this City, except that the City of Grand Junction, in its name, shall have the sole power to lease, purchase, acquire, hold and dispose of real property for library purposes, construct, furnish and equip library buildings and, in the manner provided by the City Charter, to contract an indebtedness by borrowing money or issuing bonds for such purposes. Said City may receive real property by gift, grant, or devise, and said Board of Directors may receive personal property by gift, grant or devise for the use of said Library.
SECTION 3. All statutes or parts of statutes of the State of Colorado, and all ordinances or parts of ordinances of the City of Grand Junction, in conflict herewith, are hereby repealed.
SECTION 4. By reason of the fact that the City has applied for Federal aid in the construction of a public library building, and that it is necessary for the City to acquire and hold real property for such purpose, it is hereby declared that an emergency exists and that this ordinance is necessary for the immediate preservation of the public peace, health and safety, and it shall be in full force and effect upon passage and publication.

D. 1937.
