ORDINANCE NO. 567

 

AN ORDINANCE RELATING TO THE DISPOSAL OF ASHES AND RUBBISH AND REPEALING ALL ORDINANCE IN CONFLICT THEREWITH

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

SECTION 1. Deposit of Ashes Unlawful Except in Receptacle as Herein Authorized. It shall be unlawful for any owner, tenant or occupant, or any agent or employee of any owner, tenant or occupant, of any premises in said City, to deposit upon such premises any ashes removed from any furnace or stove unless such ashes be deposited in a receptacle therefor which shall comply with the provisions of this ordinance.

 

SECTION 2. Requirements For Receptacles. All such receptacles for ashes shall be built of brick, cement concrete, stone, metal, or other incombustible material. Receptacles built of brick, cement concrete, stone, or other like materials, shall have walls not less than 8 inches in thickness, except that reinforced cement concrete receptacles shall have walls not less than 6 inches in thickness and the reinforcement thereof shall be of not less than 7-gauge mesh, weighing not less than 40 pounds to the 100 square feet. Metal receptacles shall be constructed of not less than 16-gauge metal and must be securely fastened to a cement concrete base at least 4 inches in thickness, or to a similarly substantial and permanent base. All receptacles shall be constructed to contain not less than 1 cubic yard when filled. The opening used for the purpose of emptying such receptacles shall be at least 16 inches in width, and at least 14 inches in height. The doors to all such receptacles shall be made of not less than 12-gauge metal, and shall be kept in good repair and closed when not being used in the emptying of such receptacles. All such receptacles shall be constructed on the alley line, so that the same may be emptied from the alley; and no receptacle for ashes shall be allowed to overflow, or shall be so constructed that the contents thereof shall be blown about by the wind. If no space is available on which to construct such receptacle, the City Manager may issue a special permit to any applicant to use an ash can in lieu thereof. Such cans shall be kept in proper repair and fitted with lids, and the lids thereof shall be kept closed at all times when such cans are not being filled or emptied.

 

SECTION 3. Deposit of Garbage in Ash Receptacle Unlawful. It shall be unlawful for any person to deposit in any such receptacle, any garbage, refuse, or non-combustible rubbish other than ashes; and any combustible rubbish deposited therein shall be burned promptly after deposit thereof.

 

SECTION 4. Burning of Rubbish. It shall be unlawful for any person to set fire to any rubbish or waste material of any kind, upon any street, alley or lot within the fire limits of this City except within a furnace or stove, or such receptacle as is provided by this ordinance; and it shall be unlawful for any person to set fire to such material within 40 feet of any building outside of such fire limits within said city. All fires which may be lighted for the burning of any such material shall be extinguished, or caused to be extinguished, by the person lighting the same, before 9 o'clock P.M., of the day on which the same were lighted.

 

SECTION 5. Exceptions. The provisions of this ordinance, except those contained in Section 4, shall not apply to any factory, railroad, or other industrial business within said City, which shall deposit ashes upon its premises in such manner that the same does not constitute any fire hazard or common nuisance.

 

SECTION 6. Penalty. Any person who shall violate any of the provisions of this ordinance shall be fined in a sum not less than $5.00 nor more than $100.00, and each day of continued violation of any of the provisions hereof by any person shall constitute a separate offense.

 

SECTION 7. Repeal. Ordinance No. 391, as amended by Ordinance 402, and all other ordinances and parts of ordinances in conflict herewith are hereby repealed.
