ORDINANCE NO. 570

AN ORDINANCE VACATING PARTS OF FIRST AVENUE AND TENTH STREET IN MILLDALE SUBDIVISION IN THE CITY OF GRAND JUNCTION.

WHEREAS the State Highway Department of the State of Colorado is the owner of Blocks 6 and 7, and the North one-half of Blocks 8 and 9 of Milldale Subdivision of the City of Grand Junction, Colorado, which Blocks are adjacent to each other, and has requested that said City vacate the streets within the exterior lines of said property as follows, to-wit:

1st Avenue from the east line of 9th St., eastward to the corporate limits of said City along the east line of said Blocks 7 and 8, and 10th street from the north line of the alley through said Blocks 8 and 9 northward to the south boundary of the right of way of the Denver and Rio Grande Western Railroad Company; and

WHEREAS the City Council of said City finds that the vacation of the above described parts of said streets will not injure the rights of the public or interfere with the necessities thereof, and that such requested vacation may be granted without material interference with public travel upon other streets of said City;

THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

SECTION 1. That 1st Avenue from the east line of 9th Street eastward to the corporate limits of said City, and 10th Street from the north line of the alley through said Blocks 8 and 9 northward to the south boundary of the right of way of the Denver and Rio Grande Western Railroad Company, all in Milldale Subdivision of the City of Grand Junction, Colorado, be and the same are hereby vacated as public streets, and that the fee title thereto shall revert to and vest in the present owner of the abutting property as provided by Section 116, Chapter 163, Colorado Statutes Annotated.
