ORDINANCE NO. 588

 

AN ORDINANCE CONCERNING ADDITIONS TO AND SUBDIVISIONS OF THE CITY OF GRAND JUNCTION, COLORADO

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

Section 1. PLAT OF LOTS, STREETS AND ALLEYS MUST CONFORM AND BE APPROVED BY THE COUNCIL BEFORE SALE--PENALTY. It shall be unlawful for any person or persons to plat or lay out into streets, alleys, blocks and lots, any land within the corporate limits of the City of Grand Junction, and offer the same or any part thereof for sale, either publicly or privately, unless it be platted in strict conformity with the requirements of the charter and the ordinances of said city, and plat thereof accepted by the council.

 

Any person violating any of the provisions of this section shall, upon conviction thereof, be fined in a sum not exceeding three hundred dollars.

 

Section 2. SHALL BE SURVEYED BY CITY ENGINEER OR LICENSED SURVEYOR. All additions to or subdivisions of the City of Grand Junction hereafter sought to be laid out in lots, blocks, streets and alleys shall be surveyed by or under the direction of the City Engineer, or by a licensed surveyor subject to the approval of the City Engineer.

 

Section 3. STREETS AND ALLEYS THEREOF TO CONFORM TO ADJOINING ADDITIONS. The streets and alleys of such additions and subdivisions shall be made to conform to the streets and alleys of adjoining laid-out additions and subdivisions, unless otherwise specifically authorized by the Council; but if the land sought to be laid out shall not join any addition or subdivision already laid out, then the streets and alleys shall be so laid out as to conform to those of the nearest laid-out addition or subdivision.

 

Section 4. LINES--HOW DEFINED--LEVELS--STONES SET AT CORNERS. The surveys of such new additions and subdivisions shall define the lines of streets by means of stones not less than two feet long and four inches square, properly marked, or iron bolts not less than two and one-half feet long, one and one-half inches in diameter, set or driven one foot below the established grades of the streets at all the points of intersections of range lines; said range lines to be run approximately twenty feet from the northerly and westerly sides of each street. Stones shall be planted at each and every corner and angle of the outer boundaries of additions and subdivisions laid out under this ordinance. Levels shall be taken over all the streets and avenues of such additions and subdivisions, so that grades may be established upon the same by the City Engineer.

 

Section 5. MAPS TO BE MADE AND KEPT - DISTANCES SHOWN - OTHER DATA. On completion of the surveys a map shall be made, uniform in style and scale with the official maps of the City, on which shall be shown all distances and angles, positions of range stones and bolts, locations and elevations of bench marks, and all other data which may serve to permanently establish and preserve the survey.

 

Section 6. PROFILES - GRADE ELEVATIONS - STREET LIES AND CENTERS. Profiles shall also be made, uniform in style and scale with the official profiles of the City, on which shall be shown the ground and grade elevations of the center and side lines of all streets, avenues and courts.

 

Section 7. MAPS SHALL BE CERTIFIED - TO BE APPROVED BY COUNCIL - DUPLICATE OPEN TO INSPECTION. Said map and profiles shall be certified by the surveyor and approved by the City Engineer as to the accuracy of the surveys and maps, and their conformity with the requirements of this ordinance, and shall be presented to the Council for formal acceptance. When so accepted they shall be indorsed as "Approved by the Council," and attested by the City Clerk. The original maps and profiles shall be filed with the City Engineer, and shall be open to inspection at all reasonable hours by property owners and others interested in such maps and profiles, and duplicates of such maps shall be filed with the County Clerk and Recorder, as required by law, and one furnished the Assessor of Mesa County.

 

Section 8. RANGE STONES - REMOVAL OF - PENALTY. Any person or persons, unless duly authorized by the City Engineer, who shall uncover, remove, displace or mutilate the range stones imbedded in the streets of the City of Grand Junction shall, upon conviction, be fined not less than ten dollars nor more than fifty dollars for each such offense.

 

Section 9. EMERGENCY CLAUSE. In the opinion of the City Council an emergency exists and this Ordinance is necessary for the immediate preservation of the public health and public safety, and therefore, this ordinance shall be in full force and effect immediately after its passage and publication.
