ORDINANCE NO. 592

 

"AN ORDINANCE PROVIDING FOR THE SUBMISSION TO A VOTE OF THE DULY QUALIFIED ELECTORS OF THE CITY OF GRAND JUNCTION, COLORADO, AT A SPECIAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, THE 26TH DAY OF JULY, A. D., 1938, THE QUESTION OF AUTHORIZING THE CITY COUNCIL OF SAID CITY TO CONTRACT AN INDEBTEDNESS ON BEHALF OF THE CITY AND UPON THE CREDIT THEREOF BY ISSUING THE BONDS OF SAID CITY IN THE AGGREGATE AMOUNT OF $110,000.00 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A SEWAGE DISPOSAL PLANT, TOGETHER WITH CERTAIN INTERCEPTING SEWERS."

 

WHEREAS, the City of Grand Junction has heretofore made application to the Federal Public Works Administration for a Grant-in-aid of the construction and installation of a Sewage Disposal Plant and certain Intercepting Sewers within the aforesaid city; and

 

WHEREAS, the said Public Works Administration has advised the City of an allotment of the Grant to said City for such purpose of approximately $83,344.00, representing approximately 45% of the estimated cost of construction of said improvements; and

 

WHEREAS, the City desires to accept said Grant-in-aid but has no funds on hand which may be used for said purpose; and

 

WHEREAS, the City Council deems it for the best interest of said City to issue the bonds of said City in the amount of $110,000.00, for the purpose of raising funds to aid in the construction of said improvements; and

 

WHEREAS, the funds to be raised from the issuance of said bonds, together with said Federal Grant-in-aid, will be sufficient, in the opinion of the City Council, to make said improvements; now, therefore, in consideration of the premises,

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

Section 1. That at a special municipal election to be held in said City on Tuesday the 26th day of July, A. D., 1938, the following question shall be submitted to the vote of the qualified taxpaying electors of said City:

 

QUESTION:

 

"Shall the City Council of the City of Grand Junction, Colorado, be authorized to issue the negotiable coupon bonds of said City in the aggregate principal amount of $110,000.00 for the purpose of constructing and installing a Sewage Disposal Plant and certain Intercepting Sewers?"

 

Section 2. The question so submitted shall be voted on at a special municipal election by the voters qualified, as aforesaid, at the polling places in each election precinct, as follows:

 

City Hall

Western Slope Garage

Y. M. C. A.

Richard Warren Garage

High School Gymnasium

 

The voting shall be by ballot of the form hereinafter provided, and said election shall be in all respects, as nearly as may be, held and conducted in the manner prescribed by law in cases of elections for municipal officers.

 

Section 3. The ballots to be used in voting upon the question, above submitted, shall be prepared and furnished by the City Clerk to the Judges of Election, to be by them furnished to the voters, and shall set forth the above mentioned question together with the words "For Sewage Disposal Plant Bonds" and "Against Sewage Disposal Plant Bonds."

 

Section 4. No ballots for or against said question shall be received by the Judges, unless the person is a qualified tax-paying elector of the City;

 

Section 5. The vote at said election on the question aforesaid, shall be canvassed and returned, and the return made and the result declared in the same manner, as nearly as may be, as provided by law for the canvass, return and declaring of the result of the votes cast at an election of municipal officers.

 

Section 6. The following are hereby appointed to serve as Judges and Clerks in each of the election precincts for said election as follows:

 

Mary Wing, Jennie Bear, Myrtle Friend, Anna Casteel, Helen Penny, Rose B. Woody, Marion Hutton, Lucile Craft, Gifford Fahrmeyer, Hazel Lindenschmitt, Mrs. J. A. Barraclaugh, Agnes Goodrich, Mary Brusse, Jennie Dixon, Mrs. R. M. Hightower, Nellie Cox, Geo. Sievert, Bertha Shellengerger, Vallie Boyes, Marie Nowlan, Harry Kissinger, Bertha Peters, Leta Sykes, Emily B. Ross, Rose Hall.

 

Section 7. Notice of the time and place of said election shall be published in The Daily Sentinel, a daily newspaper of general circulation, published in the City of Grand Junction, Colorado, for three successive days before such election, the first publication thereof to be not less than fifteen days prior to such election; and a copy of such Notice shall also be posted at each place of voting at least fifteen days before such election, announcing the time, place and object of the election, and the Clerk of the City of Grand Junction is hereby charged with the duty of effectuating this provision. Such Notice shall be in substantially the following form:

 

ELECTION NOTICE

 

NOTICE IS HEREBY GIVEN TO the qualified electors of the City of Grand Junction, State of Colorado, that at a special municipal election to be held in the City on Tuesday, the 26th day of July A.D., 1938, there will be submitted the following question, to-wit:

 

QUESTION:

 

"Shall the City Council of the City of Grand Junction, Colorado, be authorized to issue the negotiable coupon bonds of said City in the aggregate principal amount of $110,000.00 for the purpose of constructing and installing a Sewage Disposal Plant and certain Intercepting Sewers?"

 

That said election will be held at the polling place in each voting precinct in said City as follows, to-wit;

 

City Hall

Western Slope Garage

Y. M. C. A.

Richard Warren Garage

High School Gymnasium

 

that the said polls will be open from 7 o'clock A. M. to 7 o'clock P. M. of said day, being the time and places of holding regular municipal elections.

 

No ballot for or against said question shall be received by the Judges unless the person offering the same shall be a tax-paying elector of said City, whose name shall appear upon the registration books of his precinct.

 

The ballots to be used in voting upon the question above submitted will be furnished to the voters by the Judges of Election, to be deposited in a ballot box, which will be provided for that purpose.

 

IN WITNESS WHEREOF, the City Council of the City of Grand Junction, in the State of Colorado, has caused this Notice to be published, and posted as required by law, under the official seal of said City, this 29th day of June, A. D., 1938.

Section 8. This ordinance being an ordinance calling an election in the City of Grand Junction, Colorado, the City Council is of the opinion and so finds and hereby declares that a special emergency exists, and that this ordinance is necessary for the preservation of the public peace, health and safety.

 

Section 9. This ordinance after its adoption and approval shall be recorded in a book kept for that purpose, and be authenticated by the signatures of the President of the City Council and the City Clerk, and this being an ordinance calling an election it shall take effect and be in force immediately, and shall be published in full in the Daily Sentinel, a newspaper of general circulation, published in the City of Grand Junction, as provided by charter.
