ORDINANCE NO. 600
AN ORDINANCE REPEALING ORDINANCE NO. 522 OF THE CITY OF GRAND JUNCTION, COLORADO, ADOPTED AND APPROVED JULY 5, 1934.
WHEREAS, Ordinance No. 522 of the City of Grand Junction, Colorado, adopted and approved on the 5th day of July 1934, provided, among other things, that so long as any of Grand Junction Waterworks Reservoir Bonds, dated April 1, 1934, remained outstanding, the City would set aside all the revenues, receipts, and income from its water system; that such revenues, receipts and income were pledged for the payment of said Reservoir Bonds and the interest thereon, after the payment of operating and maintenance expenses of the City's waterworks system and that the City would not pledge or otherwise encumber the net income of said waterworks system so long as any of said Reservoir Bonds or appurtenant coupons should be outstanding and unpaid; and
WHEREAS, for the payment of said Reservoir Bonds and the interest thereon the City had previously provided for the levy of a tax on all the taxable property within said City, as required by the Constitution and laws of the State of Colorado, and the Charter of said City; and
WHEREAS, said Reservoir Bonds were duly delivered and the purchase price therefor was duly received by the City on the 11th day of June, 1934; prior to the adoption and approval of said Ordinance No. 522; and
WHEREAS, said provisions of said Ordinance No. 522 seriously impair the finances of the City and prevent the construction and installation of needed improvements to the waterworks system of said City; and
WHEREAS, the City Council which adopted said Ordinance No. 522 exceeded its power and abused its discretion in adopting such ordinance:
THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
Section 1. That said Ordinance No. 522 be and the same is hereby repealed.
Section 2. That by reason of the fact that it is necessary at the earliest possible time to make needed improvements to the waterworks system of said City; it is hereby declared that a special emergency exists and that this ordinance is necessary for the immediate preservation of the public peace, health and safety and that it shall take effect upon passage.

D. 1938.
