ORDINANCE NO. 608

 

AN ORDINANCE PROVIDING FOR THE PAYMENT OF 85% OF

LIQUOR LICENSE FEES TO THE STATE OF COLORADO

 

 WHEREAS, the Supreme Court of the State of Colorado has ruled that the amendment to the Constitution known as the Old Age Pension Amendment provides for the payment of 85% of all liquor license fees collected by the municipalities into the Old Age Pension Fund contrary to Section 24 of House Bill No. 192 passed by the 1935 Legislature, and

 

 WHEREAS, all of said liquor license fees have been placed and retained in the General Fund of the City of Grand Junction as provided by said Section 24 of House Bill No. 192 of the 1935 Session, and no provision has been made for payment of said 85% to the State of Colorado.

 

 NOW, THEREFORE, BE IT ORDAINED By the City Council of the City of Grand Junction that the sum of $8,563.75 be and the same is hereby appropriated out of the funds on hand in the General Fund, for the purpose of paying to the State of Colorado 85% of $10,075.00 collected during the years 1937, 1938, and 1939.
