ORDINANCE NO. 651
AN ORDINANCE REGULATING THE SALE OF FERMENTED MALT BEVERAGES
WHEREAS, Chapter 89, Section 6, C.S.A., 1935, provides that the licensing authorities shall have the power to make such rules and regulations with respect to the sale of "fermented malt beverages", as they may deem proper, not inconsistent with the provisions of law;
WHEREAS, as used in this Ordinance, the term, "fermented malt beverages", shall be construed to mean any beverages obtained by the fermentation of any infusion or decoction of barley, malt, hops or any similar product or any combination thereof in water containing not more than 3.2% alcohol by weight and such "fermented malt beverages" as is commonly known as 3.2 beer;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, MESA COUNTY, COLORADO:
Section 1. SALES PROHIBITED. That any person, firm or corporation heretofore or hereafter licensed by the said City Council to sell "fermented malt beverages" in Grand Junction, Colorado, shall not sell, serve or distribute upon their premises, "fermented malt beverages" between the hours of twelve o'clock midnight and six o'clock A. M. the following day.
Section 2. LICENSE REVOKED. If evidence is presented to the said City Council that said licensee has violated the terms and provisions of this Ordinance, as aforesaid, the license of said licensee shall be revoked.
Section 3. PENALTY. Any person, firm or corporation violating any of the provisions of this Ordinance shall, on conviction thereof, be fined a sum of not less than ten dollars and not more than three hundred dollars for each offense.
