ORDINANCE NO. 664

 

 AN ORDINANCE AMENDING ORDINANCE NO. 606

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

 Section 1. That Section 2 of Ordinance No. 606, entitled "Milk and Milk Products" be and the same is hereby amended so that as amended the said section shall read as follows:

 

 Section 2. LICENSE REQUIRED. It shall be unlawful for any person to receive, sell, offer for sale, deliver, or have in storage in any milk plant or in any place where milk or milk products are sold or served, any milk or milk products as defined in this ordinance within the limits of the City of Grand Junction, or its police jurisdiction, without first having obtained a license or permit as herein provided, except sales or deliveries to manufacturing plants which are licensed by the State of Colorado for the manufacturing of dairy products and which are not required by this ordinance to have a license as a milk plant.

 

 Section 2. That Section 11 of Ordinance No. 606 be and the same is hereby amended so that as amended the said section shall read as follows:

 

 Section 11. GRADING. No milk or milk products shall be sold to consumers, nor to restaurants, soda fountains, grocery stores, or similar establishments, except Grade A pasteurized, or certified, all as defined by the 1939 Edition of the United States Public Health Service Milk Ordinance as the same is now printed or may be from time to time hereafter added to, revised, or amended, a copy of which shall be kept on file in the office of the City Clerk and subject to public inspection.

 

 Section 3. That Article III of Ordinance No. 606 be and the same is hereby amended so that as amended the said Article III shall include in proper numerical sequence, in addition to the present sections and provisions thereof, the following sections and provisions:

 

 Section 12 (a). That for the purpose of this Ordinance, wherever the term Emergency Milk Shortage is used herein, it shall mean the time commencing with the passage of this Ordinance and continuing until the City Council shall declare the emergency ended by resolution.

 

 Section 12 (b). For the duration of the Emergency Milk Shortage the Chief of Department of Health and Parks and the City Veterinarian are hereby authorized to approve the permits of milk producers who produce raw milk for pasteurization when the said milk, upon delivery to the pasteurization plant, shall have an average bacterial plate count of not to exceed 1,000,000 per cc., or a comparable direct microscopic count, or an average reduction time of not less than 3 1/2 hours, and when the said milk shall be produced on premises on which buildings, installations, equipment, water supply, facilities methods and procedures incident to the production, storage and transportation of raw milk are, in the opinion of the Chief of Department of Health and Parks and the City Veterinarian such as to assure that there is delivered to the pasteurizing plant a wholesome milk.

 

 Section 12 (c). That during said Emergency Milk Shortage all milk shall be labeled as pasteurized milk and not labeled as to grade.

 

 Section 12 (d). That the above Sections 12 (a), and 12 (b) and 12 (c) shall be in full force and effect during the Emergency Milk Shortage, and all other ordinances or parts of ordinances which are in conflict with these sections are temporarily suspended during the duration of the Emergency Milk Shortage.
