ORDINANCE NO. 706
AN ORDINANCE VACATING A PORTION OF RICE STREET.
WHEREAS, the Biggs-Kurtz Hardware Company has petitioned the City Council to vacate a portion of Rice Street consisting of a strip of land fourteen (14) feet in width along the West side of Rice Street commencing with the North side of the intersection with Main Street and running North one hundred fifty (150) feet;
AND WHEREAS, the said Biggs-Kurtz Hardware Company has offered to deed to the City of Grand Junction a strip of land fourteen (14) feet in width along the East side of the same portion of Rice Street, as well as a strip of land to the North which will enable the City to have a thirty (30) foot right of way so that Rice Street can be opened from Main Street to Grand Avenue;
AND WHEREAS, the vacation of this portion of Rice Street will not cause any injury to the public, and the acquisition of additional right of way will be of benefit and convenience to the public;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO;
Section 1. That the following described portion of Rice Street be and the same is hereby vacated;
Beginning at the southeast corner of Tract 9, Little Bookcliff Railroad Yards; thence north 150 feet to the northeast corner of Tract 9, Little Bookcliff Railroad Yards; thence east 10 feet; thence south 29 feet; thence east 4 feet; thence south along a line parallel to and 14 feet from the east line of Tract 9, Little Bookcliff Railroad Yards to a point on the north line of Main Street; thence west to point of beginning.
Section 2. That existing electric power, telephone, gas, water, or other utility lines now constructed on the area to be vacated be permitted to remain in their present locations and that in the event removal becomes necessary, such removal will be done at the expense of the owners of the adjacent property.
