ORDINANCE NO. 712

 

 AN ORDINANCE ESTABLISHING A DEPARTMENT OF PUBLIC HEALTH, PROVIDING FOR THE APPOINTMENT OF A DIRECTOR OF PUBLIC HEALTH AND DEFINING THE DUTIES AND POWERS THEREOF.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. DEPARTMENT OF PUBLIC HEALTH. There is hereby created and established a department of municipal government of the City of Grand Junction, Colorado, which shall be known as the Department of Public Health, which shall consist of the Health Officer whose appointment and qualifications are provided for in the Charter for the City of Grand Junction, a Director of Public Health, and such assistants as may be needed to properly perform the duties of that department. The Health Officer and the Director of Public Health may be one and the same person.

 

 Section 2. DIRECTOR OF PUBLIC HEALTH. The City Manager shall appoint a Director of Public Health who shall, under the direction of the Health Officer, be in charge and control of the Department of Public Health.

 

 The Director of Public Health shall either be (a) a graduate of an approved school of medicine, (b) a graduate of an approved school of veterinary medicine whose training included instruction in public health as pertains to man, or (c) a graduate of an approved school in bacteriology or public health administration who has had at least three years practical experience in administrative public health duties, including the enforcement of public health ordinances or regulations.

 

 Section 3. DUTIES OF DEPARTMENT OF PUBLIC HEALTH. The Department of Public Health shall make sanitary investigations, inspections, and inquiries into all matters pertaining to the public health, shall take whatever precautions it may deem necessary to prevent the introduction or spread of contagious, infectious, or communicable diseases dangerous to the public health; shall abate any condition which constitutes a public health nuisance; and shall enforce all laws of the State of Colorado and ordinances of the City pertaining to the public health which are now in force or may hereafter be adopted.

 

 Section 4. RULES AND REGULATIONS. The Department of Public Health is hereby authorized and empowered to make and enforce such reasonable rules and regulations as it may deem necessary to perform the duties hereinabove set forth and to carry out the provisions of any ordinance pertaining to the public health.

 

 Section 5. POLICE POWERS. The representatives of the Department of Public Health shall have the power to enter at any time, any place within the City of Grand Junction or within its police jurisdiction, where they have reason to believe a disease or any other condition may exist which would be detrimental to the health of the people of the City of Grand Junction or where an ordinance pertaining to the public health is being violated; to make an investigation thereof; and to make any quarantine or isolation which they deem necessary because of the presence of a contagious disease, or to abate any nuisance to the public health which is found to exist therein.

 

 Section 6. REPEAL. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.

 I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 712, was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 4th day of September, A. D. 1946, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said city at least ten days before its final passage.
