ORDINANCE NO. 729

 AN ORDINANCE AMENDING ORDINANCE NO. 280, AS AMENDED, CONCERNING LICENSES FOR SECONDHAND BUSINESS.

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 Section 1. That Section 1 of Ordinance No. 280, as amended, shall be and it is hereby amended, so that as amended, it shall read as follows:

 Section 1. SECOND-HAND BUSINESS -- FEE FOR LICENSE. No person, firm or corporation, either as principal, agent or employee, shall establish, engage in, or carry on the business of dealing in second-hand articles, either separately or in connection with some other business, without first having obtained a license therefor from the City Clerk of said City, for which the license fee shall be the sum of $25.00 per year, or fraction thereof. The term "business of dealing in second hand articles," as used in this ordinance, shall mean and include the purchase or sale of any second hand articles of whatsoever nature; provided that nothing contained herein shall be construed to apply to pianos, books, magazines, tapestries, burlaps, paintings, drawings, etchings, engravings, bicycles, motorcycles, automobiles, or automobile accessories, including tires, or to exchanges, returns or credits of merchandise when the article or articles exchanged, returned or credited are accepted in full or part payment for any merchandise.

 Section 2. The City Council hereby finds that a special emergency exists; that this ordinance is necessary for the preservation of the public peace, health and safety and that it shall take effect upon passage.
