ORDINANCE NO. 742

 

 AN ORDINANCE RELATING TO THE ACQUISITION, INSTALLATION AND OPERATION OF PARKING METERS, ESTABLISHING A PARKING-METERED ZONE, AND PROVIDING PENALTIES FOR THE VIOLATION OF THIS ORDINANCE, AND DECLARING AN EMERGENCY.

 

 WHEREAS the increasing use of the public streets of the City of Grand Junction by vehicular traffic, and the resulting congestion in the downtown area has created a condition requiring a greater regulation of such traffic; and

 

 WHEREAS the occupancy of the public streets of Grand Junction by vehicles for parking purposes, and the use of vehicles for such purposes, and the exclusive privilege thereby appropriated during such occupancy, require the exercise of the governmental powers of the City of Grand Junction for the regulation thereof for the purpose of relieving traffic and street congestion, preventing the abuse of parking privileges, increasing parking privileges for a greater number of citizens, accelerating the free movement of traffic and, as a part of the municipal traffic system, promoting public safety and convenience; and

 

 WHEREAS the requirement of a fee for such occupancy, use and privilege aforesaid, and the installation of parking meters for collection and time measurement of such fee, are necessary, together with related limitations of parking for the accomplishment of the governmental purposes aforesaid; and such fees are necessary and applicable for the purchase, installation, maintenance and renewal of such system of parking meters, and the cost of street traffic regulation and the enforcement and control thereof and the supply and maintenance of adequate services therefor;

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. Definitions. (a) The terms "street," "vehicle" and "parking" are used in this ordinance as the same are defined in Traffic Ordinance No. 529 of the City of Grand Junction now in force and effect, or ordinances amendatory thereof.

 

 (b). Parking meter shall mean a mechanical device designed for the purpose of automatically gauging and indicating the time within which a vehicle is or may be parked within prescribed limits.

 

 (c). A parking-metered space shall be a space or section of a street within defined lines, designed for the accommodation of some vehicle at a place where the time of parking shall be gauged or recorded by a parking meter.

 

 (d). Parking-metered zone shall be an area within the corporate limits of the City of Grand Junction within which parking meters may be officially installed and operated.

 

 (e). The word "holidays" shall mean New Years Day, Decoration Day, The Fourth of July, Labor Day, Armistice Day, Thanksgiving Day, Christmas and any day declared by proclamation of the president of the City Council to be a holiday.

 

 Section 2. A parking-metered zone within the City of Grand Junction is hereby established as follows: Main Street from the East line of Second Street to the West line of Seventh Street; Rood Avenue from the East line of Third Street to the West line of Seventh Street; Third Street from the North line of Colorado Avenue to the South line of Rood Avenue; Fourth Street from the North line of Colorado Avenue to the South line of Rood Avenue; Fifth Street from the North line of Colorado Avenue to the South line of Rood Avenue; Sixth Street from the North line of Colorado Avenue to the South line of Rood Avenue; Seventh Street from the North line of Main Street to the South line of Rood Avenue.

 

 Section 3. A parking meter shall be placed upon and firmly fastened to the curb or sidewalk bordering upon the adjoining metered space. This provision shall apply to all metered spaces within said zone. All meters shall be maintained in good workable condition and shall indicate the time allowed for parking and the amount of deposit required to be placed in said meter for parking during said time, which deposit shall consist of two five-cent coins for permission to park for two hours or a one-cent coin for permission to park for twelve minutes, or other combinations of coins at the same rate of one cent for each twelve minute parking.

 

 Section 4. Every meter shall indicate the length of time that a vehicle has been parked from the time of depositing such coin or coins, and shall continue in operation at least until the expiration of the time fixed for parking as indicated on said meter. Each meter shall be so devised as to display a signal when said time has expired. Every vehicle thereafter remaining in such metered space shall be deemed and considered as overparked, which shall be unlawful and in violation of the provisions of this ordinance.

 

 Section 5. Every vehicle parked in a metered space shall be parked in such a manner that the meter shall be visible from the street over the hood of said vehicle. When any vehicle shall be parked in a metered space the owner, operator, manager, driver or occupant of said vehicle upon entering said metered space shall immediately deposit or cause to be deposited a five-cent coin or other proper coin of the United States so indicated upon said meter for said deposit; provided however the parking provisions herein contained within said zones shall not be in force and effect prior to the hour of nine o'clock A. M. or subsequent to the hour of six o'clock P. M., or on Sundays or holidays.

 

 Section 6. Ordinance 529 of the City of Grand Junction and the rules and regulations thereunder relating to parking and movement of vehicles, and ordinances amendatory thereof, shall be applicable within parking-metered zones, including the establishment and regulation of loading zones, bus stops, taxicabs and sightseeing vehicles; and all general police ordinances and regulations shall be cumulative with the provisions of this ordinance and applicable within metered zones.

 

 Section 7. The regulations referred to in Section 6 hereof may provide for the loading and unloading of merchandise or passengers of public or private carriers at specified times without meter payment therefor.

 

 Section 8. It shall be the duty of the City Manager to cause to be made regular collections of the money deposited in said meters and to deliver and account for the same to the Treasurer of the City of Grand Junction.

 

 Section 9. It shall be a violation of this ordinance to deposit or cause to be deposited in any parking meter any slug, device or substitute for any lawful coin of the United States.

 

 Section 10. It shall be a violation of this ordinance for any unauthorized person to remove, deface, tamper with, open or willfully break, destroy or injure any parking meter installed under the provisions of this ordinance.

 

 Section 11. The procedure for arrest or collection of fines for violation of this ordinance shall be the same as provided in Sections 80, 81, 83 and 84 of Ordinance No. 529, as amended.

 

 Section 12. The City of Grand Junction shall purchase, lease or otherwise acquire as many parking meters as may be necessary or requisite to install in said metered zone or future extensions thereof or addition of like zones. The type of said meters to be selected shall be determined by the City Council upon competitive bids. The Council may reject any or all bids, and shall not be restricted in selection to the lowest priced meter, but shall select such type of parking meter as in their judgment, all things considered including the price, are best suited and of the greatest advantage to the City of Grand Junction; the consideration paid or to be paid for the purchase, leasing or other acquisition and installation of said parking meters shall be paid out of the proceeds obtained from the operation thereof upon such basis or percentage as may be agreed upon. No contract shall be made which obligates the City of Grand Junction to pay any sum whatever for such meters and the installation thereof other than a percentage of the receipts therefor; and no contract shall be made which does not reserve for the city the right to order the contractor to remove said meters and equipment without expense to the city on thirty days notice after a designated trial period of not to exceed six months from the completion of installation.

 

 Section 13. Penalties. Any person who shall violate any provisions of this ordinance shall, upon conviction thereof, be punished by a fine of not less than $1.00 nor more than $300.00 for any one offense.

 

 Section 14. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.

 

 Section 15. This ordinance shall be in full force and effect upon adoption, as provided by the Charter of the City of Grand Junction, but if the said meters are not installed by that time, enforcement of this ordinance is hereby suspended until completion of the installation of meters herein provided for and the publication in The Daily Sentinel that the said meters are installed and in operation.

 

 Section 16. In order to more properly regulate the traffic situation in the City of Grand Junction a special emergency exists. Therefore the City Council finds and determines that the passage of this ordinance is immediately necessary for the preservation of the Public peace and safety and that it shall take effect upon its passage.

D. 1947, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said city at least ten days before its final passage.
