ORDINANCE NO. 772

 

 AN ORDINANCE VACATING A PORTION OF UTE AVENUE

 

 WHEREAS the Independent Lumber Company has requested the City Council to vacate that portion of Ute Avenue lying Northeast of the right-of-way of the Denver and Rio Grande Western Railroad and South of Block 11 of Mobley's Subdivision and West of the East line of said Block 11 extended South:

 

 AND WHEREAS the City Council finds that the said street is a blind street which has no opening on the West; that the Independent Lumber Company is the owner of the land on both sides of and adjacent to the part of said street which is sought to be vacated; that the said portion of the said street is not now and cannot be used by the City, and that the vacation of this portion of the said street will not cause any injury to the public or interfere with public travel upon the other streets and alleys of the City; and that the said vacation would be to the best interest of the public convenience and necessity;

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That all that part of Ute Avenue lying Northeast of the right-of-way of the Denver & Rio Grande Western Railroad Company, South of Block 11 of Mobley's Subdivision, and West of the East line of said Block 11 extended South, shall be and the same is hereby vacated.

 

 Passed and adopted this 4th day of August, A. D. 1948.

 I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 772 was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body, held on the 21st day of July, A. D. 1948, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said city at least ten days before its final passage.
