ORDINANCE NO. 773
AN ORDINANCE AUTHORIZING THE LEASING OF REAL ESTATE TO THE COLORADO STATE NATIONAL GUARD.
WHEREAS, the City of Grand Junction is the owner of the real estate hereinafter described, which real estate is not used or held for park purposes, public utility purposes, or any governmental purposes:
AND WHEREAS, the Colorado State National Guard desires to lease the said real estate for the purpose of erecting thereon an armory building and a motor transport building and the construction and maintenance of a parade ground, which facilities may be used by the citizens of Grand Junction when the same are not being used by the Colorado State National Guard;
AND WHEREAS, such use of the premises will be of benefit to the City of Grand Junction;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
That the City lease to the Colorado State National Guard the following-described property, to-wit:
Lots 1, 3, 5, 7, 9, 11, 13, 15, 17, 19, 21, and 23 in Block 4 of Grand River Subdivision; all that portion of land lying West of Lot 23 of said Block 4 and extending to the Colorado River; Lots 2, 4, 6, 8, 10, 12, 14, 16, 18, 20, 22, 24, 26 and 28 in Block 7, Grand River Subdivision; all land lying between said Lot 28 of said Block 7 and the Colorado River; and all land lying between the West end of White Avenue and the Colorado River, in Mesa County, Colorado; for the purposes above set forth for a term of ninety-nine years from this date at an annual rental of One Dollar per year payable on August 1st of each year, upon the express terms and conditions that the lessee will indemnify the City and save it harmless from any and all claims, damages, demands, actions, and costs of every nature in any manner arising or resulting from any of their said operations under this lease; that the lessee shall agree to keep the said premises and all buildings erected thereon in a reasonable state of repair so that they will present a good appearance to the public; and that if the said buildings should hereafter cease to be used by the lessee for the purposes hereinabove set forth, or if the local unit of the Colorado State National Guard should at some future time cease to exist, then this lease may be terminated by the City and upon such termination any buildings which have been constructed on the said premises shall become the property of the City of Grand Junction.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 773, was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 4th day of August, A. D. 1948, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said city at least ten days before its final passage.
