ORDINANCE NO. 779
AN ORDINANCE CREATING AND ESTABLISHING A RECREATION DEPARTMENT, PROVIDING FOR A RECREATION BOARD, AND DEFINING THE POWERS AND DUTIES THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
Section 1. There is hereby created and established a Recreation Department for the use and benefit of the inhabitants of the City of Grand Junction and vicinity.
Section 2. The City Council shall appoint a board of directors consisting of nine members to be known as the Recreation Board, each member of which shall serve for a term of two years and without compensation. Two of such members shall be the City Manager and one other officer of the City of Grand Junction, two of such members shall be appointed from the officers of School District No. 1, and five of such members shall be appointed at large from the residents of the City of Grand Junction. In order that the terms of office of the members of the Recreation Board shall not all expire at the same time, the Council shall appoint four members to serve only for the first year, and thereafter appointments of either five or four members shall be made annually.
Section 3. All members of the board shall serve until their successors have been appointed and have qualified. Any vacancies in the said board shall be filled by the City Council.
Section 4. The members of the Recreation Board shall elect a chairman from their membership by ballot, and the City Manager shall be Secretary of the Board.
Section 5. Meetings of the Recreation Board shall be held at such times and places as the members may determine. It shall adopt its own rules of procedure and keep a record of its proceedings showing the action of the Board and the vote of each member upon each question considered. The presence of five members shall be necessary to constitute a quorum.
Section 6. Subject to the limitations hereinafter set forth, the said Recreation Board shall have the power and it shall be its duty to promote and provide a program for the recreational and leisure-time activities of the residents of Grand Junction, Colorado, and vicinity. It shall also have the power to employ a Director of Recreation and such other employees as it may deem necessary for providing and maintaining such a recreational program. The Recreation Director shall have the power and authority to schedule the use of all recreational facilities.
Section 7. It shall not be lawful for the said Recreation Board, or any employee thereof, to incur or contract any expense unless an appropriation, shall have been made therefor by the City Council.
Section 8. All moneys appropriated by the City Council or received for the use of the recreational program shall be kept separate and apart from all other moneys of the City; and the same may be drawn upon by the proper officers of the City upon properly authenticated vouchers of the Director of Recreation.
Section 9. The City Council shall have the sole power to lease, purchase, acquire, hold and dispose of real or personal property for recreational purposes and it shall have the sole power to contract any indebtedness for such purpose. The City may receive real or personal property by gift, grant or devise for use of the said Department of Recreation.
Section 10. The Recreation Board shall annually before the first day of October make a report to the City Council of the Recreational program which it has provided during the preceding year, the number of persons taking part in the recreational program, such other statistical information and subjects which it deems to be of general interest, and its recommendations for a budget for the Department of Recreation for the following calendar year.

D. 1948, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said city at least ten days before its final passage.
