ORDINANCE NO. 788

 

 AN ORDINANCE SUBMITTING TO THE QUALIFIED TAXPAYING ELECTORS OF THE CITY OF GRAND JUNCTION, COLORADO, AT THE GENERAL MUNICIPAL ELECTION TO BE HELD APRIL 5, 1949, THE QUESTION OF AUTHORIZING THE ISSUANCE OF PARK IMPROVEMENT BONDS OF SAID CITY IN THE PRINCIPAL AMOUNT OF $60,000, AND THE QUESTION OF AUTHORIZING THE ISSUANCE OF CITY ADMINISTRATION BUILDING BONDS IN THE PRINCIPAL AMOUNT OF $110,00, AND DECLARING AN EMERGENCY.

 

 WHEREAS, the City Council of the City of Grand Junction, Colorado, deems it advisable to improve Lincoln Park by constructing football and baseball stadia and appurtenances, and to convert the old Lowell School into a City Administration Building to contain city offices and an auditorium; and

 

 WHEREAS, the City does not have in its treasury sufficient money available for such purposes; and

 

 WHEREAS, the City Council deems it necessary and desirable to issue bonds of the City for such purposes, subject to the approving vote of the qualified taxpaying electors of the City;

 

 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That at the general municipal election to be held in the City of Grand Junction, Colorado, on the 5th day of April, 1949, there shall be and there is hereby submitted to a vote of the qualified taxpaying electors of the City the following questions:

 

 FIRST QUESTION SUBMITTED:

 

 "Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City, in the aggregate amount of $60,000 for the purpose of improving Lincoln Park by constructing football and baseball stadia and appurtenances in said Park?"

 

 SECOND QUESTION SUBMITTED:

 

 "Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City in the aggregate amount of $110,000, for the purpose of converting the old Lowell School into a City Administration Building to contain city offices and an auditorium?"

 

 Section 2. Only qualified registered taxpaying electors of the City shall be permitted to vote upon the questions submitted.

 

 Section 3. The questions so submitted shall be voted on at said election by qualified electors, at the polling places designated for the general municipal election. The vote shall be taken by ballot in the form hereinafter set forth, and such election shall in all respects be held and conducted as nearly as may be in the manner prescribed by law for elections of municipal officers.

 

 Section 4. The ballots to be used in voting upon the questions submitted shall be prepared and furnished by the City Clerk to the judges of election, to be by them furnished to the voters, and they shall be in substantially the following form:

 INSTRUCTIONS TO VOTERS: The voter shall prepare his ballot, indicating his approval or disapproval of the foregoing propositions by placing a cross (X) opposite the group of words above which expresses his choice on each of said questions, and shall then deposit his ballot in the ballot box provided for such purpose.

 

 Section 5. The judges and clerks appointed to conduct the election of officers for said City shall conduct the election on the bond questions hereinbefore set forth.

 

 Section 6. The vote cast at said election on the questions aforesaid shall be returned and canvassed and the results declared in the same manner as nearly as may be as provided by law for the return, canvass and the declaration of the result of votes cast at an election of municipal officers.

 

 Section 7. A notice of the time and place of said election shall be published on three successive days before said election, in The Daily Sentinel, newspaper of general circulation published in the City of Grand Junction, Mesa County, Colorado, the first of which publications shall be at least fifteen (15) days before such election, and a copy of such notice shall be posted at each place of voting at least fifteen (15) days before such election, and the City Clerk is hereby charged with the duty of effectuating this provision.

 

 Said notice to be published and posted as aforesaid shall be in substantially the following form:

 PUBLIC NOTICE IS HEREBY GIVEN That at the general municipal election to be held on April 5, 1949, in the City of Grand Junction, Colorado, at the polling places designated for said election, there shall be submitted to the vote of the qualified taxpaying electors of the City the following questions:

 

 FIRST QUESTION: "Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City in the aggregate amount of $60,000 for the purpose of improving Lincoln Park by constructing football and baseball stadia and appurtenances in said Park?"

 

 SECOND QUESTION: "Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City in the aggregate amount of $110,000 for the purpose of converting the old Lowell School into a City Administration Building to contain city offices and an auditorium?"

 

 The polls will be open continuously from the hour of 7:00 o'clock a.m. to and until the hour of 7:00 o'clock p.m. The ballots to be used in voting upon the question submitted will be prepared and furnished by the City Clerk to the judges of election, to be by them furnished to the voters. The election will be held and conducted as nearly as may be in the manner prescribed by law for elections of municipal officers.

 

 Registration for said election will take place in the manner now provided by law. Any person possessing qualifications to vote at said election but whose name does not appear on the official registration list, may register with the City Clerk of Grand Junction, Colorado, at any time during business hours up to and including Friday, the 25th day of March, 1949, ten days before said election.

 

 IN WITNESS WHEREOF, the City Council of the City of Grand Junction, Colorado, has caused this notice to be published and posted as required by law, and dated this 23rd day of February, 1949.

 Section 8, By reason of the fact that this Ordinance must be made effective in time to permit the publications of the election notice, and the further fact that this Ordinance provides for a referendum on the questions to be submitted at said election, it is hereby declared that a special emergency exists, that this Ordinance is necessary for the preservation of the public peace, health and safety, and that it shall take effect upon passage and shall be published in The Daily Sentinel on the day following its passage.

D. 1949.
