ORDINANCE NO. 796

 

 AN ORDINANCE VACATING THAT PORTION OF SOUTH AVENUE BETWEEN TENTH STREET AND TWELFTH STREET.

 

 WHEREAS, the Public Service Company of Colorado, The Standard Oil Company of Indiana and the Grand Valley Water Users Association have requested the City Council to vacate that portion of South Avenue lying East of the East side of Tenth Street and extending East to the right of way of the Denver & Rio Grande Western Railroad Company which intersects the said South Avenue between Eleventh Street and Twelfth Street;

 

 AND WHEREAS, the City finds that the said street is a blind street which has no opening on the East; that the said three companies requesting this vacation own the land on both sides of and adjacent to the part of the street which is sought to be vacated; that the said portion of the said street has not been used for public travel for many years, if it was ever used for said purpose; that the vacation of this portion of the said street will not cause any injury to the public or interfere with public travel upon the other streets and alleys of the City; and that the said vacation would be to the best interests of the public convenience and necessity.

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That all that part of South Avenue lying East of the East side of Tenth Street and extending East to the right of way of the Denver & Rio Grande Western Railroad Company which intersects the said South Avenue between Eleventh Street and Twelfth Street shall be and the same is hereby vacated; provided however, that the City of Grand Junction shall have a perpetual easement or right of way across the said property for the construction, maintenance and removal of water lines, sewer lines, electric lines, and other public utilities.

 

 Passed and adopted this 17th day of August, 1949.

 I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 796 was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 17th of August, A. D. 1949, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
