ORDINANCE NO. 815

 AN ORDINANCE VACATING A PORTION OF POPLAR AVENUE IN THE CITY OF GRAND JUNCTION

 WHEREAS in the plat of Grandview Subdivision there was dedicated to the use of the public a strip of land 30 feet in width, designated as Poplar Avenue, and lying along the East side of and adjacent to Lots 4 and 5 of said subdivision; and

 WHEREAS the said lots have now been annexed to the City of Grand Junction and have been replatted as a portion of Block 6 in Elmwood Plaza, according to the refiling thereof; and

 WHEREAS the said Poplar Avenue has now been changed to 19th Street, and that portion lying between Bunting Avenue and North Avenue has never been opened to public travel and it is now desired to have an 18 foot alleyway between Bunting Avenue and North Avenue instead of a wider street; and

 WHEREAS the vacation of a portion of the said street which has never been used by the public will not cause any injury to the public and will be to the best interests of the City of Grand Junction, and of the citizens thereof;

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 1. That the following strip of land which is shown upon the plat of Grandview Subdivision as being a portion of Poplar Avenue, shall be and the same is hereby vacated, and that the fee title thereto shall be deemed and taken to vest in the owner of the property adjoining the said strip of land on the West, to-wit:

 Beginning at a point 50 feet north and 10 feet West of the South quarter corner of Section 12, Township 1 South, Range 1 West of the Ute Meridian, thence West 20 feet, thence North 270 feet, thence East 20 feet, thence South 270 feet to point of beginning, which said property shall become a part of Lot 4 in Block 6 of Elmwood Plaza according to the refiling thereof; also beginning at a point 340 feet North and 10 feet West of the South quarter corner of said Section 12, thence West 20 feet, thence North 125 feet, thence East 20 feet, thence South 125 feet, which said property shall, become a part of Lot 3 in Block 6 of Elmwood Plaza according to the refiling thereof.

 I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 815 was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 20th day of September, 1950, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
