ORDINANCE NO. 0816

 

 AN ORDINANCE VACATING THE ALLEY IN BLOCK 154 BETWEEN 11TH STREET AND 12TH STREET

 

 WHEREAS, the Public Service Company of Colorado has petitioned the City Council to vacate the alley in Block 154, City of Grand Junction, between 11th Street and 12th Street, in order that it may make more effective use of said Block 154 and construct a protective fence around its property; and

 

 WHEREAS, the City finds that the Public Service Company of Colorado is the owner of all the property in Block 154 on both sides of the alley; that the alley does not extend beyond 12th Street to the east, that both 11th Street and 12th Street are blocked by the D&RGW Railroad main line right of way along the south side of this block; that the alley is not used and is not required for public travel or use; that the vacation of the alley in said Block 154 will not cause any injury to the public or interfere with public travel upon other streets and alleys of the city; and that the said vacation of the alley would be to the best interests of public convenience and necessity.

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

 Section 1. That the alley in Block 154, City of Grand Junction, between 11th Street and 12th Street shall be and the same is hereby vacated; provided, however, that the City of Grand Junction shall have a perpetual easement or right of way across said property for the construction, maintenance and removal of water lines, sewer lines, electric lines and other public utilities.
