ORDINANCE NO. 833

 

 AN ORDINANCE VACATING A PORTION OF EIGHTH STREET AND FIRST AVENUE IN THE CITY OF GRAND JUNCTION, COLORADO.

 

 WHEREAS, the Kuner-Empson Company is the owner of the property abutting upon Eighth Street and First Avenue at and near the intersection of the said two streets and they have requested the City to vacate the portion thereof which is hereinafter described; and

 

 WHEREAS, the said portion of the street is not now used by the City and the City Council finds and determines that a vacation thereof will not cause any injury to the public and it will be to the best interests of the City of Grand Junction and the citizens thereof;

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 That the following described portion of Eighth Street and First Avenue, to-wit:

 

 Beginning at the northeast corner of Lot 14 in Block 1, Milldale Subdivision, thence east 20 feet, thence south 185 feet to the south line of First Avenue; thence west 20 feet; thence north to point of beginning.

 

 shall be and the same is hereby vacated, subject to the right of way easement for the construction, operation and maintenance of water, sewer, power, gas and other public utility lines, and that the fee title to the portion so vacated shall be deemed and taken to vest in the owner of the property abutting upon the portion so vacated.

 

 Passed and adopted this 21st day of March, 1951.

 I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 833 was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 7th day of March, 1951, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
