ORDINANCE NO. 840

 

 AN ORDINANCE VACATING A PORTION OF THIRD AVENUE IN THE CITY OF GRAND JUNCTION, COLORADO.

 

 WHEREAS the S. J. Miller Packing Company is the owner of the property lying along the North side of and abutting upon Third Avenue between Seventh Street and Eighth Street in the City of Grand Junction; and

 

 WHEREAS by reason of a variation in surveys made by different engineers, the buildings belonging to said company and erected upon said property have been constructed so that they extend a few inches into the public street; and

 

 WHEREAS the City Council has been requested to vacate the North 0.5 feet of said Avenue, which said portion of the Avenue is not now used by the City, and the City Council hereby finds and determines that vacation thereof will not cause any injury to the public and that it will be to the best interests of the City of Grand Junction and the citizens thereof;

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 That the North 0.5 feet of that portion of Third Avenue lying between the East boundary line of Seventh Street and the West boundary line of Eighth Street shall be and the same is hereby vacated, and the fee title to the portion so vacated shall be deemed and taken to vest in the owner of the property abutting upon the portion so vacated.

 

 Passed and adopted this 15th day of August, 1951.
