ORDINANCE NO. 861

 

 AN ORDINANCE AMENDING SECTION 90 OF ORDINANCE NO. 780 CONCERNING TRAFFIC AND THE IMPOUNDING OF VEHICLES.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO.

 

 Section 1. That Section 90 of Ordinance No. 780 shall be and the same is hereby amended so as to read as follows:

 

 "Section 90. AUTHORITY TO IMPOUND VEHICLES. The Police Department is hereby authorized to remove a vehicle from a street, or highway to the nearest garage or other place of safety, or to a garage designated or maintained by the Police Department, under the circumstances hereinafter enumerated.

 

 (a) When any vehicle is left unattended upon any bridge, viaduct, or at any place where such vehicle constitutes an obstruction to traffic.

 

 (b) When a vehicle upon a highway constitutes an obstruction to traffic and the person in charge of the vehicle is incapacitated to such an extent as to be unable to provide for its custody or removal;

 

 (c) When a vehicle is left upon a street as junk or for storage or without displaying state license plates for the current year, for a period of more than five days.

 

 Whenever an officer removes such a vehicle from the street and knows or is able to ascertain the name and address of the owner thereof, such officer shall immediately give or cause to be given written notice to the owner of the fact of such removal, the reason therefor, and the place to which the vehicle has been removed. No vehicle which has been impounded as herein provided shall be released until the charges for towage and storage have been paid by the owner".
