ORDINANCE NO. 862

 

 AN ORDINANCE CONCERNING THE COLLECTION AND DISPOSAL OF GARBAGE: PROVIDING PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES CONCERNING GREASE TRAPS AND ALL OTHER ORDINANCES IN CONFLICT WITH THIS ORDINANCE.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. DEFINITION OF GARBAGE. The word garbage, as used in this ordinance, shall mean every refuse accumulation of animal, vegetable and other matter that attends or results from the preparation, consumption, dealing in, or storage of meats, fish, fowls, fruits, foods, or vegetables.

 

 Section 2. GARBAGE CANS. It shall be the duty of every owner or his agent or the occupant of any store, hotel, restaurant, packing house, dwelling, building, flat, apartment or tenement where persons reside, board or lodge, or where animal or vegetable food is prepared or served or kept, to provide at their own expense, and at all times to maintain in good order and repair, a vessel or vessels for garbage, and it shall be the duty of every occupant, tenant or person in possession as aforesaid, to cause to be deposited in said vessels all garbage produced or brought into such building, dwelling, flat, apartment or tenement. The cans or vessels required by this section shall be water-tight metal cans, each having a tight fitting cover so that they will receive and hold without leakage or escape of odors, all garbage which accumulates on said premises, and all such cans shall be kept readily accessible to the collector near the alley line. In sections of the city which do not have alleys, the said garbage cans shall be kept at the front curb line, or a charge may be made for collecting garbage from any place other than the alley line or the front curb line.

 

 Section 3. CONTENTS OF GARBAGE CANS. It shall be unlawful for any person to place or deposit in such garbage cans any ashes, tin cans, waste matter, rubbish, or any other matter which is not included in the foregoing definition of garbage.

 

 Section 4. COLLECTION OF GARBAGE REGULATED. All garbage shall be collected and removed by such person or persons as may be under contract with the City or by employees of the City. No person other than the official garbage collector shall collect or haul upon the city streets or alleys, any such garbage, and no person shall permit any person other than the official garbage collector to collect or haul any garbage away from any premises owned or occupied by him.

 

 Section 5. GARBAGE TRUCKS. All trucks or vehicles used for the collection and removal of garbage shall be fitted with a good and substantial water tight metal tank which shall prevent the escape of any of the contents thereof.

 Section 6. ADDITIONAL REGULATIONS. The City Manager shall have the power to prescribe such other rules and regulations as he may deem proper for the storage, collection and removal of garbage from the City.

 

 Section 7. PENALTY. Any person who violates any provision of this ordinance shall, upon conviction, be subject to a fine of not less than one dollar nor more than three hundred dollars.

 

 Section 8. REPEAL. Sections 9, 11, 12 and 13 of Article III of Ordinance No. 179; Sections 1, 4, 7, 9 and 10 of Ordinance No. 310; Section 1 of Ordinance No. 710; Section 1 of Ordinance No. 764; and all other ordinances or parts of ordinances in conflict herewith are hereby repealed.
